MONDAY COUNCIL MEETING 2/6/12 (Housing Problems)

There were only 2 items on the agenda at last night's city council meeting but there was plenty to discuss. The main issue was R-12-03 which passed 6-3, and yes I was one of the six voting in favor of this resolution.

It is not that I am opposed to safe and affordable housing for our elderly or that I am opposed to the Reitz building being renovated. The problem I saw was that it appeared that the company would not be able to proceed without the tax credits. Additionally, I could not see how this company could make a profit with the numbers we were given. The cost of renovation was around 12 million, and each unit costing $167,000. With the rental income being generated at an average of $500.00 a month or so, how will this generate a profit? It just did not seem that the Sterling Group had done the profit amount of research.

The other proposed housing development, the Summit Springs, was not even discussed at the meeting. I do not believe this development is necessary, especially considering the proposed location.

There is sure to be more to come, especially concerning the Reitz building which is in a prime location and would make a beautiful building for loft style apartments.

COUNCIL MEETING JANUARY 19, 2012

We had another light agenda at last night's meeting. The meeting was preceded by a work session which involved a presentation from Jack Bobo and Mainland Properties.

The Riverview Project has been broken down into three phases. The first will be retail, and include the parking garage, the second will be rental apartments, and finally condos. This was changed because of the economy and the banks' reluctance to finance large projects at this time, especially condos. Mainland has seen interest from several local banks, so that is good news. The design has changed also, two new archtecutal firms have been hired, Studio A and QK4, both from Louisville. There is less plaza space and the buildings are closer in design to the existing downtown buildings. They are hoping to break ground in the next couple of months.

The only agenda item in the regular meeting was an Ordinance to increase the number members of the Bicentennial Commission from five to nine. With the Bicentennial so close, CM Zurschmeide said the members expressed a need for more members. There was a unaminous vote on the first two readings. CM Caesar suggested that David Barksdale be added to the Commission.

On another topic there will be a meeting Monday at 6:30 at Slate Run School for a discussion on the Master Plan for our sewer and stormwater projects. CM Coffey will again be the moderator and requests as much public input as possible. Please try to attend.

OFF AND RUNNING

We had a light agenda at last night's council meeting. The only Resolution was concerning a tax abatement for Jones Popcorn. They need to purchase equipment for a new line and expect to hire 15 more people.

The "real" work will begin at our next regularly scheduled meeting on Jan. 19.

I also want to congratulate our new Council President, Diane Benedetti and VP, Kevin Zurschmeide. We have a good group of council members and we have pledged to work together and help make New Albany a better place to live and work.

CITY COUNCIL MEETING 12/15/11 GOODBYE AND GOOD LUCK

Last night was the last of the regularly scheduled City Council meetings for 2011 and the last meeting for this term. There will be a special meeting 12/28/11 for the third reading of the Ordinance to refinance the bond for Christian Academy. The city is only allowed to issue $10,000,000 in bonds per year and this needs to be passed in 2011.

Other agenda items included CM Coffey's G-11-16, the third reading on the Abandoned Vehicle Ordinance which passed 9-0.

And finally CM Price's G-11-17 third reading on the Noise Regulation Ordinance it also passed 9-0.

Mr. Ed Wilkinson gave a report on the Sewer Dept. There have been many improvements to our sewers in the last year and we are in much better shape financially. There has been another $200,000 + collected from delinquent bills, this is in addition to the previously reported $750,000. Great job Ed!

This meeting was also short and sweet, or maybe bittersweet. Mr. Gahan thanked the council for their service this last year. Mr. Messer thanked the council for their help in the last eight years and expressed how much he appreciated his time in office. Mr. Price had a different goodbye message. He thanked the council for "putting up with him" for the past eight years. This, of course, brought laughter to an otherwise solemn moment.

Prior to the council meeting, the Police Dept. had a meeting at Scribner Jr. High School concerning artificial marijuana and cocaine. This is a very serious subject and was well presented by Chief Bailey. Unfortunately it was poorly attended. The Chief thought this was because the seminar was not well advertised. I don't know what happened but I hope they have another presentation because this is very valuable information for all the parents and family members in New Albany.

I don't know what 2012 will bring. There will be a lot of changes, I just hope and pray that New Albany will continue to grow and prosper.

CITY COUNCIL MEETING 12/5/11

Tonight's city council meeting was relatively quiet. I guess everyone wants to end the year on a positive note, or they are thinking about the holidays.

First of all I want to commend Josh Lawrence, an Eagle Scout candidate who changed those ugly rocks on the hillside near the river from "welcome" to a beautiful sign spelling New Albany. If they ever re-open the Sherman Minton Bridge we will have to pleasure of seeing this sign daily. Josh was helped by his father, Asst. Police Chief Mike Lawrence and members of his troop.

Now back to the meeting:

R-11-31 Benedetti
Cost of Living Recognition Payment for non-bargaining employees. The amount was determined by their years of employment. The funds were part of an appropriation from the EDIT Fund which has been left unused. For 49 employees the total of the bonuses was $45,750. Instead of the usual show of hands CM Coffey asked for a roll call. It was passed with 5 Yay votes and 3 Nay (Coffey,Price,McLaughlin) (CM Messer was absent)

G-11-16 Coffey 1 & 2
Amendment to the Abandoned Vehicle Non-Reverting Fund. The proceeds from the fines will be used to pay the expenses for a tow-in-lot and offset fuel costs for the police and fire departments. Passed 8-0.

G-11-17 Price 1 & 2
Amendment to the noise regulation. This was a clarification to the original ordinance with specific fines for each offense.
$50.00 1st offense, $100.00 2nd offense. Passed 8-0

G-11-18 Coffey 1 & 2
This was the Ordinance authorizing $6,000,000 in Sewage Works Revenue Bonds.CM Coffey tabled this for now and asked to chair the standing committee.

A-11-26 Coffey 2 & 3
Ordinance for the Appropriation of Rainy Day Funds $500,000 for MVH (Street Dept.) and $100,000 for the Parks Dept. Passed 7-1 CM Zurschmeide cast the Nay vote.

A-11-27 Caesar 3
Final vote on the Ordinance for the Appropriation of EDIT Funds. This was the 2.3 Million dollars transferred to the General Fund to balance the budget.Passed 6-2 with CM Price & CM Zurschmeide voting Nay.

There were a few tabled Ordinances which were withdrawn.

The meeting went pretty smoothly, especially considering the lengthy agenda. Let's hope this trend continues.

BUDGET WOES

As expected, the State has cut our city budget again this year. This year we could be over as much as 3 million dollars.

Naturally this is a major concern for all of us and difficult decisions must be made. There has been a lot of talk about cutting expenses or raising taxes, and naturally neither option is appealing to anyone. Now is certainly not the time to raise taxes with the economy in the shape that it is in. So that leaves cutting expenses. Where should we begin?

I don't have the answer to that question but I want to find out. I think the City Council needs to hold a series of budget meetings to go over the budget line by line and see where cuts, if any, can be made. The public should also be allowed to view this information either on line or in print. This is our money and our budget. Yes, I know we are legally entitled to this information. But we need easier access. Not everyone has the opportunity to attend meetings or visit the Controllers Office during business hours. We hear a lot of talk about transparency, I think the City of New Albany needs more transparency. The more knowledge people have the better they become at decision making.

LET'S GET THE WORD OUT

The "Tribune" reported that residents will be able to receive funding to repair their homes even if they are still living in them.

New Directions Housing Corp. is making funds available for emergency repairs. The amounts go up to $5,000 and are available to homeowners with a combined household income totaling 80% or less than the New Albany average. That comes out to $49,450 for a family of four, per Daniel Suddeath's article. Deputy Mayor Carl Malysz encourage residents to contact the New Directions office for more information.
Their number is (502) 589-2272.

This is administered through the New Albany Redevelopment Commission (812) 948-5333. So I would suggest that homeowners call each department to obtain as much help as is available.

Executive Director Joe Gleissner spoke about obtaining additional grant funding during the 2/7/11 city council meeting. CM Messer asked about the homeowners who needed repairs to their roof or other areas. He said that the grant funds should be shared with these people. Mr. Gleissner said that legally the funds must be used only for vacant properties. He offered to make an effort to let resident of the SEJ neighborhood know what funds are available to them.

We need to help Mr. Gleissner with this effort. And we need to tell residents in other neighborhoods about New Directions.

CITY COUNCIL MEETING 2/7/11

There was a lot of discussion about the budget tonight and how to make it balance. In fact there were two resolutions with opposite opinions on how to accomplish this feat.

R-11-05 Resolution to Not use EDIT Funds for Anticipated 2011 Budget Shortfalls. CM Benedetti talked with someone in the office of the DGLF who said they would send down a budget whether or not there was a deficit in the General Fund.

A-11-02 Ordinance For the Appropriation of EDIT Funds CM Ceasar wrote an Ordinance which was the total opposite of CM Benedetti's.

Both failed. It was that kind of night. However CM Gahan called for a work session for the 2011 budget process to begin.

There were a couple of positive steps, though:

We will have metal detectors in the City-County Bldg. with guards on duty.
There will be a Board set up to determine how to combine our city and county 911 systems.
CM Gonder will replace CM Price (with his permission) to the Historic Preservation Committee. Also the Mayor will send letters to all residents in historic districts to advise them that they live in an historic district.

Yes, there were several things accomplished but the meeting was still too long, 7:30 to 10:00. The members are going to have to manage their time a little better.

Warren Nash

With all of the buzz about the candidates running for Mayor or City Council, one important topic has been slightly overlooked.

And that is the systematic effort to sabotage Warren Nash's career. Mr. Nash has done a fine job as the Director of Solid Waste for several years and now for no apparent reason he was told that his services were no longer needed.

I don't know the reasoning behind this, but from what I have read there is no good reason. If it's politics, the Democrats need to step up to the plate and defend member who has served the party for all of his life. If it's his age, then everyone, even young people, should be up in arms because if we live long enough we all may be subject to age discrimination.

Either way, this puts a black mark on the citizens of New Albany.

UNPAID TICKETS

I just can't get over the article in the"Tribune" about the unpaid parking tickets. The part that got to me was when Marcey Wisman-Bennett said that some people had to count out their change to pay their tickets. That just broke my heart.

HEY BUDDY, CAN YOU SPARE $100,000?

I arrived late at the City Council meeting last night. Sheriff Mills was at the podium talking about the plan for metal detectors for the City-County Bldg.

The Council did approve a non-binding Resolution which basically says they agree that they are needed. CM Coffey abstained because he did not see a need for the Resolution since an Ordinance will be ready for voting at the next meeting.

The doors facing Hauss Sq. would be open to the public and where we will have to pass through the detectors. The employees will be given cards so they can scan them to enter the other doors.

I have been very vocal about my support for this measure and applaud Sheriff Mills for taking the initiative and securing all of the equipment. The $100,000 will be used for salaries for four additional security officers for this year. After that the Building Authority will add this cost to the rent. My husband suggested that the city and county ask for donations from the Floyd County residents to help pay the cost. Not a bad idea in my opinion.

TOASTING LETTY

I had the honor and priviledge to be in attendance for the Toast for Letty Walter this evening at the Culbertson West.

It was part of the Business and Professional Women's annual scholarship fundraiser. And it was the best event I have witnessed in my five or so years as a member of BPW. Some of my sister members who have been in BPW far longer also said it was the best event we have ever held.

Culbertson West was filled to capacity with 250 or so of Letty's closest friends and relatives. Suellen Wilkerson and Rosalee Dowell (who flew home from Florida) were the chairpersons of our committee, and they did a fantastic job, as did our President, Sarah Ring and all of the other committee members. The Hon. J. Terrence Cody was the emcee with several of New Albany's civic leaders speaking in tribute. Mayor England declared today "Letty Walter Day" and Commissioner Mark Seabrook read a resolution making January 24 "Letty Walter Day" in Floyd County from now on.

Carl Holliday and Steve Goodman were excellent hosts, as usual and provided a beautiful dinner.

I have not know Letty for as long as many other guests. But to know Letty is to love her, and she makes everyone feel that they are lifelong friends.

HOUSE BILL 1022

Rep. Tom Saunders R-District 54 has introduced a bill which would ban employees from serving in two capacities in the city or county. In other words, Councilmen Jack Messer and Ted Heavrin would not be able to retain their positions as police officers and run for public office. I think this is a bill that should have been passed a hundred years ago.

Now readers, before you get all upset, let me explain that I was only using CM's Messer and Heavrin as examples. I have nothing against either of these men personally but they are city and county police officers and currently serve on the city and county councils respectively.

As you probably know, any Federal employee cannot serve as an elected public servant. If a postal worker cannot be an elected official why should a police officer, or a city sanitation worker, or street department employee? I have always thought this was unfair. To me it seems like a conflict of interest. I know the above mentioned council members always abstain from voting on matters such as salary, but they are still drawing two paychecks from the same local government, which I have heard many people refer to as "double dipping".

So, I want to say that I am thankful to Rep. Saunders for introducing this bill and Rep. Ed Clere for his support.

THE DOWNTOWN PLAZA

I am still trying to get my head around the idea of the city having to foot the 12 million dollar expense for a parking garage on the riverfront.

The idea of a plaza with condos, stores, and other businesses right in the middle of our downtown is certainly exciting. It will create a lot of jobs and boost our local economy, no argument on that. It will also be a huge money maker for Jack Bobo and other realtors and developers.

We all know there will be large tax incentives for everyone involved also.

So would someone please explain to me why Mr. Bobo insists that he cannot make all of this come true without the help of the city (read New Albany taxpayers)? Yes, the city will receive tax dollars over a 20 year period but Mr. Bobo and friends will make huge profits all along. He said that he would not ask the city to contribute more than it would gain. Would he make an investment in someone said to him, "Jack, I'm not asking you do contribute more than you would gain". He would probably tell them thanks but no thanks, since the plan would call for him to break even. He did not get where he is by only breaking even.

I don't claim to be an accountant or financial wizard but I just don't see why Mr. Bobo and friends can't build this building, complete with garage, without asking for the help from the city.

AND WE'RE OFF!

Apparently most of the important business was settled in the 48 hours prior to tonight's meeting. Jeff Gahan was the only nominee for Council President. John Gonder took his gavel and name plate and resumed his previous spot between Diane Benedetti and Jack Messer.

After that there was a lot of discussion on which committee each member would serve. It basically came out to about the same except that Diane Benedetti is off of the Fire Dept. Committee and on the Police Dept. Committee.

A couple of contracts seem to be up for renewal, namely Mathew Lorch, the council attorney and Ed Wilkinson, the Stormwater Engineer. It looks like both gentlemen will keep their jobs since they have done well and no one is eager to replace them.

Maybe our next meeting will have more on the agenda and thus be more entertaining. There was a woman taping the meeting. Unfortunately, I did not meet her or get her name but I was told that she is working on a documentary about local government and plans to tape the council meetings in the area. Maybe next time we will give her a good show.

2010 OH, WHAT A YEAR IT WAS

As 2010 comes to a close I have been doing a little reminiscing. It was a good year for some and a bad year for many. Our economy is still in a mess, we are fighting two wars and may even be involved in a third one soon if North Korea has it''s way.

And on the local scene we have had a tough year too. I went back and checked out old articles and have listed the topics in sort of a chronological order. I'll keep my comments to a minimum but invite everyone to add their own.

Flooding was a major problem for residents in several ares of town. The sewers and storm drains were cleaned out and this seemed to have helped.
Sewer rate increases: We didn't want this to happen but it passed anyway.
Delinquent sewer bills. Some progress has been made but we still have a long way to go.
Annexation. Put off another year.
LOIT tax. Another unpopular topic.
Historic Preservation, the commission was saved. But we will always have controversy.
Grant for the S. Ellen Jones/Midtown neighborhood. Dilapidated homes are being repaired or torn down and more local residents are being employed to help.
Combine the 911 city and county call centers.
P.O.P. more concentrated police presence in various areas of town. Seems to be working, especially with the 20 arrests on the apartment complex on Green Valley Rd.
Globe Mechanical expanding and adding 40 jobs.
The election.
Bridge tolls. Why can't they just build the east end bridge and see what happens?
New Albany's Budget.

Here's hoping that 2011 finds everyone working and living in safe warm homes with plenty of food. I know that is not possible but let's see how close we can come.

Baron Hill is visiting every county in the 9th District, but not to say goodbye. He started this morning in Salem, and is ending the day in Clarksville, visiting 10 cities in 48 hours. He called it his "See You Later" tour.

He stopped by the Floyd County Democratic Headquarters this evening to have a quick but meaningful visit with some of his constituents. He was very frank and open, as always, and answered our questions.

He is very concerned about Congress, as are many others. He said the new Congress Members are mostly newly elected as are many other elected officials, including clerks. The clerks, many which are untrained, will be in charge of the 2012 elections and there will be mistakes. (Thankfully the voters of Floyd County have re-elected Linda Moeller so we are in good shape.) The untrained Congress Membership is much more frightening. It's going to be totally new territory for many.

Baron is unsure about his own future but he has been talking to a lot of people and he is very hopeful. (He did say, however that Betty wants him to stay off the campaign trail for a little while). He promised to stay informed politically and keep us here in New Albany informed as well. He was happy to say that his staff members are finding new positions, both locally and in Washington. As he said, that just shows what a good reputation his employees enjoy.

I just want to wish Baron the best here on this blog as I did downtown. Hopefully soon we will have to opportunity to welcome him back into public service. (fingers crossed)

It looks like Globe Mechanical wants to purchase the buildings which were formally occupied by the street department. The asking price was $300,000 and Globe is offering $225,000. Yes the bid is much lower than the asking price, but these days no one can sell for asking price. And besides, no one else is interested in these buildings.

Globe Mechanical wants the space so they can expand and hire 40 more workers. I say sell the buildings already and let them put 40 people to work.

"POP' GO THE BAD GUYS

New Albany Police Chief Todd Bailey held a meeting last night at the New Albany Public Library which was well attended. There were members of a couple of neighborhood associations and other interested citizens. We all came away with a feeling of hope for our fair city. Although the program will begin in the SEJ neighborhood, the whole city will be covered. And other neighborhoods are scheduled to be part of the POP plan also.

Chief Bailey began by saying that he was a native of New Albany who lives on Elm St. with his family. He also expressed a great concern for the community. He has only been chief for eight weeks but he is eager to make changes.

The police force will be working in a different way from now on. They will be pro-active instead of reactive, and will also be ready and willing to listen to our concerns. The new plan is called "Problem Oriented Policing" or "POP".

There was also a slide presentation with information which is listed below:

New policing concept designed to attack crime in problems areas of town.
Replaces outdated process of simply responding to crime in the community.
Will deal with quality of life issues such as loud music, code issues, juvenile problems, vandalism, thefts, graffiti and drug and alcohol matters.
"POP' works hand in hand with "Intelligence Oriented Policing".
Interviewing known criminals and analyzing data to pinpoint trouble and to direct strategy.
We will seek your input and suggestions regarding some of the problems to solve.
Police personnel will engage in "POP" activities daily beginning Jan. 1, 2011.
Our Night Shift will implement the program with tactical operations in the SE Jones area and surrounding areas.
Additional community problem areas and problem topics will be immediately addressed.
ZERO TOLERANCE

This is just a part of the information on the slides. They went on to ask everyone to get involved and join neighborhood watch groups, which will be re-instated. He also gave NAPD contact information.

The crime line is for callers to leave tips, and they do not have to give their name, but it is preferable to identify yourself and be a witness in court if necessary.

The police also have a Facebook page and will soon have twitter and a web page.

Chief Bailey thinks that things don't need to be done a certain way just because that's the way things have always been done.

Building Commissioner David Brewer was also present and he is eager to make changes also. He said the previous Code Enforcement Officer only had the authority to send letters to offenders. The city council has approved the hiring of another code enforcement officer, one to handle problems in the office and another to be out looking for violations. He promised that from now on issues will be taken care of instead of just sending letters.

As I said earlier, the people in attendance were excited about making New Albany safe again. Everyone was asked to complete a short questionnaire listing problems in their neighborhood and asked to participate watch groups. I encourage everyone to help with this endeavor.

CITY COUNCIL MEETING 12/6/10

The Mayor was the first to speak at the podium Monday evening. These are the points he made:

The city will continue to pick up leaves until 12/23/10
There is a study being done on our ambulance service.
We need to combine the city and county 911 systems.

CM Coffey asked Atty Rick Fox to explain the judgement on the sewer utility against the city. Our City Attorney, Shane Gibson, helped explain the situation. There is a judgement and they want to collect. There have been negotiations with Gibson and Fox and others and it will soon be satisfied. CM Coffey wants to pay and then sue the sewer utility for the money. Mr. Gibson thinks this is silly and added that he hoped to have a resolution by the next council meeting.

Building Commissioner, David Brewer spoke about our code enforcement. With our two officers there have been 68 issues, 35 called in, 3 by email, and 2 in person. All have been resolved. Additionally, there are 18 buildings which may be demolished if they are not repaired.

The only speaker from the public was Peter Farmer, president of Main St. Preservation. He spoke against G-10-21 (Dissolution of the Historic Preservation Commission)

Next up were the votes:

A-10-13 Transfer 1.7 million from EDIT for General Fund expenses. The reason being that TIF funds cannot be used for certain projects. The vote was 6 yes and 3 no (CM's Coffey,Price, and Gahan). Same results on the second reading.

A-10-12 Ordinance for the transfer of $200,000 from the Cumulative Capital Improvement Fund to the General Fund. (Goes to cash deficit, not an appropriation, money goes to the rolling deficit) This was the 3rd reading and it passed 9-0

G-20-21 Dissolving the Historic Preservation Commission: failed 7 no, 1 yes, CM Price, and 1 abstain CM Coffey.

Finally the Resolution to adopt a Fiscal Plan for the Annexation passed 7 yes and 2 no CM Coffey and Price. The annexation will not take effect until January 1, 2014.

On a personal note, the meeting went pretty smoothly. The microphones seemed to have been set at a lower volume, or maybe it was just my imagination.

Chief Todd Bailey will host a meeting this Wednesday at the Library at 7:00. He will be starting a new program called Problem Oriented Policing program on January 1, 2011.

He wants to start more neighborhood watch groups. I hope the people will be more receptive this time. Becky Roy started a neighborhood watch group several years ago (West End) but attendance was very limited, same with the Friends and Families of the West End group.

SEWER LINE SNAG

I read in today's "Tribune" that the developers are discovering problems with the Mid-town aka. S. Ellen Jones neighborhood's outdated sewer lines. It seems that the sewer department used to allow two homes to be hooked up to the same line back in the 1920's and 30's. Since there are probably several more of these "Y" connections in the area this needs to be addressed.

Apparently Jon-Paul Inc. did not add the cost of sewer lines in their original bid for the project. Hopefully this cost will me minimal so the project does not go far over budget.

Another problem is the cost of sewer hookups which run $1650 each. This is one case where I think the City Council should waive the connection fee. This is not a new development of expensive homes. These homes will be sold to lower income residents and costs need to be kept as low as possible. New Albany was fortunate to have this grant and we should do everything we can to keep the project going and sell these homes as quickly and economically as possible.

COUNCIL MEETING 11/18/10:SAD DAY FOR NEW ALBANY

Thursday's city council meeting began on a high note with the Mayor encouraging everyone to participate in the Holiday Fest on Saturday after Thanksgiving. He went on to say that it is good to see New Albany having parking problems.

He discussed combining the city and county 911 operators, this will have to be done by 2014 anyway.

He also suggested a meeting with the City and County Councils in addition to the Commissioners. Additionally, CM Benedetti asked for a cost analysis of the budget.

In regard to the Ordinance to disband the Historic Preservation Commission, he suggested forming a mediation committee of council members from each district, the council president, the building commissioner and 2 members of HPC.

The next speaker was Chief Bailey who said there are plans for forums on crime prevention planned for next year and the citizens police academy will be offered again.

There were several citizens speaking against G-10-21 the Ordinance Dissolving the Historic Preservation Commission... and one person speaking in favor.

The discussion between the council members was quite heated but eventually CM Gonder called for a vote: The first and second readings had the same result, 7 nays, 1 aye ( CM Price), and 1 abstain, (CM Coffey)

The other ordinances were handled swiftly and quietly: G-10-12 (Ord. to transfer $200,000 from the Cumulative Capital Improvement Fund to the General Fund passed 9-0
Z-10-05 The new medical building on the corner of Daisy Lane and Green Valley Rd. passed 5-4 after CM Messer changed his vote from abstain to aye.

I had commented on other blogs, etc. about the behaviour of some of the council members last night. I know everyone jokes about the city council meetings being a 3 ring circus, but last night I was truly ashamed of our council. The room was filled to capacity and it was a sad sight for all of us to see.

LET'S SAVE OUR HISTORY

I have been very concerned about the Ordinance to dissolve the Historic Preservation Commission. Not that I am directly involved, living in an apartment complex not located in a historic district. But if we live in an historic home or not, all citizens of New Albany are involved.

There have been several historic buildings destroyed in the 1950's and 1960's, and several near misses.

When I was taking a tour of the Culbertson Mansion the tour guide told us that the home was almost torn down at one time. Can you imagine? Tearing down the Culbertson Mansion? And more recently, the Cardinal Ritter Home was saved from the wrecking ball.

I am not a member of the Historic Preservation Commission and I don't know all of the issues but I was told by a former member that their approval rate is 83 out of 84. I know there are a couple of citizens who have had problems but hopefully a compromise can be met.

As far as CM Price, the author of the Ordinance, I have known him for about seven years, and have always known him to be an honorable person. Even when we disagree, our disagreements are friendly and civil.

It appears that the meeting room in the City County Building will be crowded this Thursday. So if you plan to attend the meeting, get there early.

"I HAVE NO PLANS TO RESIGN"

Those were the words John Wilcox used when I asked him about all of the rumors about he and the rest of the Central Committee.

I had asked other members previously but had not had the chance to ask John until last night. I was not able to speak to Sam Locke but John said Sam had not expressed any desire to quit either. John went on to say that next year's election should run more smoothly since only local candidates will be running and national issues will not play a big part. He added that people tend to get more involved with local elections.

We discussed how difficult it is to find people willing to help with campaigns. I must admit that I am guilty in that respect also. There is much more that I could have done had I taken the time. But I cannot fault the Central Committee. Those people worked their buns off this year.

Being a member of the Central Committee is an unpaid and (I'm sure) a thankless job. No matter to which party a person belongs.

THERE IS NO CRABBY ROAD IN INDIANA

There was an editorial cartoon in today's "Tribune" which really made me mad. It was a "take off" of the Beatles' Abbey Road album. It showed four donkey's dressed as John, Paul, George and Ringo with the caption reading "Crabby Road". They were headed toward a sign which read "leaving DC" and the donkeys had @#%$& type symbols over their heads.

Each of our Indiana Democrat candidates posted statements on Facebook and sent emails thanking their supporters. They all said they had done their best and appreciated what everyone had done for them. This is what is known as class.

I know this is just a silly cartoon but the author, Jerry Holbert, obviously felt that this was the general mood of our candidates. I don't know where Mr. Holbert lives, this may have been written thousands of miles away but our local newspaper agreed with him. This is just plain wrong.

CITY COUNCIL MEETING 11/1/10

Last night's City Council meeting ran rather briskly compared to previous meetings.

Carl Malysz spoke first asking the Council to table R10-29 & R10-30 until after the Planning Commission has their meeting on 11/18.

CM Ceasar asked which streets are scheduled to be paved out of the appropriated million dollars. (I have been wondering that myself. Daisy Lane is still a mess between Green Valley and the top of the hill and now they are milling Coyle Dr.?)

CM Coffey asked Atty Lorch about the research on the TIF districts, if there are leftover funds and how they can be used. He will send his report in the form of a memo. He also wants annexation to be put back on the agenda for the next meeting.

CM Gahan suggested that the unused TIF funds be used for pavement and some of the pavement funds can be moved to public service.

CM McLaughlin asked Mr. Ed Wilkerson (sewer board) about the summer watering program. Mr. Wilkerson replied that the current ordinance is outdated. The Sewer Board is in the process of writing a new ordinance and will be completed in January.

Next were the comments from the public: Maurice King took issue with the changes in the way the Sewer Board plans to change the watering program. He said that people seldom refill their in-ground swimming pools, they add chemicals as necessary. And if they do refill their pools it is done in May rather than June. He wants the watering program to remain from May through September. He also noted that watering one's lawn or garden does not affect sewers in any way.
He went on to say that a $5.00 increase in sewer bills would add over $700,000 to the sewer department's income.

CM Coffey thinks that it is unethical for the same people to sit on the Sewer and the Strormwater Boards.

Next the Resolutions were introduced:

Z-10-05 Plans to build a one story doctors office building on the corner of Daisy Lane (north) and Green Valley Rd. Paul Collings from the Green Triangle Group brought a visual of the proposed building. He said that the drainage problem will be taken care of underground and the present creek will remain with a small bridge for crossing. This received a 9-0 favorable rating from the Planning Commission. CM Benedetti wants to look into the drainage solution before voting to approve.

Votes on first reading 7-2 with CM's Benedetti and Gonder voting no. The second reading produced the same results.

G-10-17 (Ordinance regarding the Historic Preservation Commission) tabled until next meeting.

G-10-20 Synthetic marijuana passed 9-0 on third reading.

R-10-29 and R-10-30 both regarding incentives for companies to install new HVAC systems in two industrial areas. Both failed with a 0-9 vote.

R-10-38 The Budget. tabled until the next meeting because he Council wants to do final tweaking. I told CM Price that I was glad that they take home police car policy will be amended. He said that was one of several money saving measures. I'm proud of our council for taking responsibility with our tax dollars.

I HATE NEGATIVE ADS. HOW ABOUT YOU?

I don't know about you but I am sick of all of these negative political TV ads. The "Tribune" ran an editorial the other day stating they did not know who started the negative ads between Shane Gibson and Ed Clere. Really. Everyone knows which party sent the negative mailings again this year just as in previous years. I have heard many people discuss their dislike of such ads but everyone agrees that they work.

I have a novel thought. Let's not vote for the party which starts throwing rocks at the other candidates.

JIM FRIEBERGER ON THE LOIT TAX

Floyd County Council candidate, Jim Frieberger answered my inquiry about the LOIT tax. With his permission I am posting his email.

"After having talked to numerous voters in my District, an overwhelming majority do not want a new tax passed at this time. So I have committed, as my opponent, not to vote in favor of the LOIT Tax if it resurfaced. In articles I have read, close to 50% of the people are being affected by the current economic downturn right now. Either them or their spouses being unemployed, having their hours reduced, taking a pay cut, or at the least, having a pay freeze, which doesn't allow them to keep up with current inflation levels. A majority of the people are cutting back during this downturn and feel that the Government should do so as well. They feel that the Council and County Government need to stay within their budget for now and unfortunately, make the tough decisions necessary to continue staying within their budget until the economy improves."

"I am hoping with my financial background and experience, I will be better equipped than my opponent to look a the currenct office budgets and try to find the best way to support the offices or programs that are essential to the county. One thing I would like to try to look into is the County Council itself being offered full Healthcare benefits for them and their family. I don't think this is reasonable for a position that is only a part-time job. This is the type of item I would like to dig into and see if there are some savings I can find for the county. We also have some tremendous inefficiencies in the County Sheriff Department due mainly to the overcrowding and ineffective lay-out of the jail. We are spending too much money on Deputies to guard prisoners when looking at typical guard to prisoner ratio's for the state, but we are being forced into for safety issues as well as keeping down our liability risk issues. We really need to push for building a new jail and using those funds that would be saved on Deputy salaries to be used for other public safety purposes."

He also added:

"I was disappointed with the Courier Journal article because it only covered about one fourth of our interview. It dropped all of my issues about the economy and me against voting in favor of a new LOIT Tax but that's what led into my support of pushing for a new jail because it is the greatest opportunity for cost savings for the county that can be used for other safety issues or projects. I think the editor didn't have enough space since he was covering three races instead of one as in his other articles (which I feel was a disservice to all of the candidates) and that he was trying to differentiate Dana Fendley and myself as much as he could."

Mr. Frieberger asked how I stood on this issue. If I have not made it clear before I will say again that I am also against the LOIT Tax. I know the city and county are in financial trouble but we must look for ways to cut expenses at this time. We taxpayers are in a financial bind ourselves and we don't need additional cuts to our net pay.

COUNCIL MEETING 10/3/10 YES, IT WAS A LONG ONE

We had another marathon city council meeting again tonight.

The first topic of discussion was the newly released audit from the State. Since some of the members had only received their copy today, Mr. Coffey asked for a meeting on a Saturday to go over the budget. The date and time decided on were 10/16/10 at 10:00AM. I do not know if this will be a closed meeting or if we the public are allowed to attend.

Mr. Zurschmeide asked Mrs. Garry when the decrease would take effect on the sewer bills. She said it will be on the November statements since sewer bills run a month behind water bills.

Mrs. Benedetti asked why there has been no paving since the council appropriated the 1 million. Mr. Rosenbarger said the milling person is working on a large project in Louisville but will get to us next week.

Next were the comments from the public. Several business owners spoke about how 1SI had helped them get started. Most prominently was John Van Cleave from T G Missouri. They plan a large expansion costing 3 million dollars, they will also hire 30 more employees. More on that later.

Agenda items:

A-10-10 Ordinance for Appropriation and Tax Rates (this is the budget)

Mr. Caesar thinks the next year will be better for the budget since the only wage increase is the 1% longevity for the police and fire depts. The budget is based on the current insurance plan, if the employees accept the new plan there will be more savings. He also cannot understand why the city and the county each have a 911 system.

The vote was 3 yays Ceasar, Messer, Gonder, and 6 nays.

The second reading was the same.

A-10-11 An Ordinance to Fix the Non-Reverting Budgets for the Year 2011

The first and second votes were 1 yay Gonder, and 8 nays.

The council will have their meeting before voting on the third reading.

Then the real fun started:

A-10-08 Ordinance For The Appropriation of EDIT Funds

This was 1SI's request for $70,000. Mrs. Benedetti asked for an amendment which would reduce the amount to $30,000. The amendment passed.

Mr. Gahan brought up the recent political endorsements made by 1SI. He asked how endorsements made our city more attractive to new businesses, which is what he thought was the job of 1SI.

Mr. Dalby went to the podium to answer questions. He said the endorsements were made by a separate committee. He said the businesses wanted a voice and this is how it is expressed. Mr. Price questioned Mr. Dalby and 1SI's position on bridge tolls. Mr. Dalby said he did not want tolls either, he just wants the bridges built ASAP however that can be accomplished. Mr. Dalby went on to say that 1SI helped create 1,600 jobs and expanded the tax base by 80 million. He added that 90% of their funding is from private donors and the public funding can only be used for economic development.

The Ordinance passed 5 yays Coffey, Caesar, Benedetti, Messer, Zurschmeide and 4 nays.

Mrs. Benedetti tabled the next resolutions. Regarding the reserved parking places for residents, she wants to change from street signs to stickers for the cars.

Regarding T G Missouri, she tabled the tax abatement and the request for $150,000 matching funds for a new HVAC system until they can be amended. The council wants to put a time limit on the non-reverting fund for businesses to purchase equipment, make sure they purchase energy efficient equipment and use only local contractors.

When I left Chief Juliot was at the podium explaining to the council the request for matching funds to purchase radios, software, etc. Guess you'll have to read Daniel's report in the "Tribune" for that one.

NO ANNEXATION, BLANK AGENDA

Tonight the City Council had scheduled a special meeting regarding the annexation of the Charlestown Rd. area. As the "Tribune" stated, the Mayor asked for the ordinance to be tabled for an indefinite period of time. The paper said he wanted to postpone the ordinance until an effective date of 2013, but Mr. England said he wanted a postponement until 2014. I don't know which date he actually meant. I guess we'll just have to go with what the "Tribune" said.

The Council did table the ordinance after a lengthy discussion. Mr. Price was concerned about the budget for the police department. After the annexation, there will be a need for additional officers. This will play havoc with our budget. He is also concerned about the number of people losing their homes due to the economy. He said New Albany may eventually be a city of tents. He also took exception to the Mayor's comment about how the Council "trashes" the police department and accuses them of overspending. Mr. England and Officer Haub, President of the FOP, agreed that the police are not given the budgeted amount needed. Things got a little heated after the meeting.

The other item on the agenda concerned the salaries for the non-bargaining employees. The ordinance was amended to state that no promotions or salary increases were allowed and no new hires. This passed 6-1, Mr. Price voted no, and Mr. Caesar and Mr. Messer were absent.

PIES AND POLITICS

I just came from a get together with some of the Democrat candidates, both local and statewide.

It was a fun time for everyone, good fellowship and great desserts.

Several of the candidates were there and gave a short talk, and talked with each of us individually.

Sam Locke, a very busy man, is having a bowling fundraiser next Wednesday 9/29 at Hoosier Lanes, 7:00.
Shane Gibson has been going door to door and has a couple of commercials showing on local TV stations.
Jim Frieberger and Dan Voyles have been campaigning in their districts for the County Council.
Patty Walker is having a hat show/fundraiser at the Division St. School, this Saturday 9/25.
Chuck Frieberger was not present but his campaign manager was. I asked where Chuck stood on the tolls for the bridges and his answer was a resounding NO TOLLS. Chuck sensibly believes that it is unfair to ask Kentuckiana residents to pay for bridges when the funds are already in place, besides who can afford to pay $6.00 a day just to go to work?
Vop Osili, candidate for Secretary of State will be at Schad & Schad Law Firm offices tomorrow 5:30 to 7:30 for a meet and greet.

Stacy Deck, VP of the Floyd County Central Committee, believes that we have a great slate of candidates and I agree.

We need to support these people with our votes and donations &/or volunteering if possible. But most importantly our votes.

COUNCIL MEETING 9/16/10

I was a surprisingly short City Council meeting tonight. There was a news crew from Fox 41 News but they had nothing to report, so they packed up early.

The big news, of course, was G-10-18: The Ordinance setting salaries for the year 2011 for the Police and Fire Depts. The Council let the Administration know where they stood on this on. They noted NO. Mr. Zurschmeide was absent but the rest were all on the same page.

Up next was G-10-19 (non bargaining unit employees), this one was tabled.

Then we had the resident only parking areas ordinance G-10-01. Surprisingly, there was a lot of discussion on this one. It was finally tabled until the council can agree on the initial fee, fines for non-compliance, and other issues.

After that CM Messer motioned for adjournment, I don't know who seconded because everyone was making a bee line for the door, me included. The time was 8:29.

"FAIR TAX"???

There was a letter in Sunday's Tribune from David B. Patterson, IN-9 Director for Fair Tax, New Albany. The letter interested me because I was unsure of what the term fair tax actually meant.

Mr. Patterson questioned why Baron Hill would not admit that this tax would help save our Social Security system and reduce our debt. On the surface this proposal sounded intriguing. He went on to urge everyone to read the 133 pages of HR25.

However, Mr. Patterson left out an important part of this resolution. Since there would no longer be an income tax, the replacement would be a 23% sales tax. This tax would be levied on every purchase, even food. So a $1.00 loaf of bread would cost $1.23 and a $2.29 gallon of milk would cost $2.77. Now who do you think would be most hurt by this tax? A person making over $500,000 a year or a person making under $30,000 a year? Maybe the person with the higher salary would purchase more big ticket items (or maybe not) but the person on the lower end of the scale must purchase food, gasoline, cleaning products, etc.

If Baron Hill is hesitant to support this tax I don't blame him. And I am glad that he is not in support of such a rip off on the middle class and working class people.

Personally, to be fair, I think that no one making under $30,000 a year should have to pay any income tax. And the people making more would only pay tax on the amount over $30,000. That is what I call a fair tax.

THIS 'N THAT

Well, I have a new computer and am back on line. In trying to write my first article in several weeks I could not decide on a subject so I will discuss several different ones.

The Tolls: Maybe you are tired of reading all of the newspapers and blogs about this subject but it is important and we need to keep letting the Bridges Coalition or whoever know we mean business and will not allow these tolls to be shoved down our throats. If anyone wants to organize a protest please let me know and I'll be there.

Sewer Bills: Today's Tribune had an article about liens being placed on properties where the sewer bill is over 90 days past due and foreclosures are forthcoming. Although I agree in the idea, I think each case should be judged individually. If a homeowner is actually trying to keep up with their obligations and cannot help from being past due, maybe we should not rush to foreclose if they have a good reason, loss of job for instance. But the homeowner should take the initiative and contact the Sewer Dept. and explain their circumstances, not just sit back and do nothing.

The Home Tour: I had purchased a ticket but unable to make it. But the weather seemed to have cooperated and the Farmers Market looked pretty crowded this afternoon so it looked like it was a success. Thanks to all of the homeowners who allowed strangers to come in an tour your lovely homes, see you next year.

Men of Distinction: This was the reason I was not able to participate in the Home Tour. I had purchased tickets for both events without realizing they were taking place at the same time. A couple of friends told me that they would disown me if I did not attend so the choice was made for me. But it was a wonderful event with Dawne Gee as the emcee and the men who certainly deserved the honor.

The Democrat Picnic: The annual Floyd County Democrat picnic takes place tomorrow at Garry E. Cavan Park aka Edwardsville Park in Georgetown tomorrow. Please come if you can. It will be a great time with good food and good fellowshop. And a big thank you to our hosts, Sheriff Darrell Mills and Linda Moeller.
Please tell them how much you appreciate their hard work when you see them tomorrow.

ANNEXATION MEETING 6/29/10

The council approved the Resolution to proceed with the process of annexation.

There were several issues but the summary is this:

The 219 acres contain mainly commercial property and very few residents. This makes it easier to annex since there is no need for an annexation committee to oversee the funds received.
CM Messer said the police will not be overburdened since the "crime" will mainly consist of parking violations and speeders, and a few shoplifters.
The Grantline Rd. firestation will be the main source of fire protection with the Twin Oaks station being the backup.
Northside Christian Church was not annexed because churches are tax exempt and will generate limited revenue plus there was concern about the number of people who would be included in the annexation.
The $700,000 gained by the city will not be a loss to the county because the property taxes are based on value. The taxes are layered in such a way that the county will still receive it's share and the city will receive the rest.

ANNEXATION: YES OR NO?

Happy Friday everyone.

Since my sinus infection still persists, I was not able to attend the special council meeting last night. Thanks to the "Tribune" though I was able to read the results. As you probably know, the annexation vote was defeated by one vote.

Again according to the "Tribune" annexing part of the Charlestown Rd. area will net the city $700,000 a year, sounds good to me. Since there will be another special meeting Tuesday I hope it does pass, providing all of the council members take the time to read the 21 page report and show up for the meeting.

Personally, I believe that if people are elected to an office they should show up for "work" and do their homework. Even if they do not support the item(s) on the agenda they should do their job. I'm not a speed reader but I think I can read 21 pages in less than 48 hours even with a full time job. This is why we voters elect people to office, not to skip meetings or complain about the lack of time to do research. If the council members think annexation will be good for the city they should vote yes, if they don't then they should explain why they voted no. I don't believe in voting no as a protest. If a person wants to protest about the lack of transparency they should do so in other ways, such as telling the administration members directly.

TOWN HALL MEETING, ETC.

The Town Hall meeting is 6:30 to 8:00 in the library tonight. Hope to see a lot you there. Judging from the comments on this blog and the new "Kitchen Table Issues" blog people have a lot to say. I just hope they show up and ask the questions.

Tomorrow is the Exclusively New Albany event and I will be one of the volunteers, so of course cannot attend the city council meeting. Someone please post comments and tell us what happened.

CITY COUNCIL MEETING 6/7/10

The first speaker was the Mayor who mentioned a couple of public forums. The first being at Our Lady of Perpetual Help Church on June 8. This will be to discuss the McDonald Lane Federal improvement project. The second will be at the library on 6/16. Both meetings will begin at 6:00PM.

He added that the funds are there to finish Daisy Lane from Green Valley Rd to the top of the hill due to stimulus funds. Mt. Tabor Rd. will be repaired with Federal Funds also. There will be a meeting at IUS to discuss this but there is no date set as yet.

As far as the rest of the paving, there are no funds available yet but he is hoping to use Riverboat and EDIT. He needs $5,000,000 for city wide paving but can make do with $500,000 from Riverboat and $500,000 from TIF.

Kay Garry was the next speaker. She asked that all department heads turn in their budgets for 2011. She added that representatives from DGLF will meet in her office on 6/15 @ 9:00AM and hopes to obtain the 1782 form for the 2010 budgets at that time. She also wants to meet with department heads on 6/21 to discuss budgets. The council decided to meet for 90 minutes for two days for budget discussions.

Shane Gibson was up next. He said that the yard waste and other trash pickup are not in the sanitation company's contract. The street dept. is now picking up these items when people call. The sanitation company wants to make a deal to include these pickups in their contract and lower their fees in order to extend their contract for another three years. Mr. Price and Mrs. Benedetti disagreed. They want more transparency for the citizens and therefore more open bids.

David Brewer (Building Commissioner) spoke about our problems with dilapidated homes and code enforcement. He hired an additional code enforcement officer, John Berger (sp). This department also has a "hot line" for complaint calls. In the last two months there have been 225 complaints on grass and weeds. Out of that they are unable to locate the owners of 95 homes. He is looking at re-doing the ordinances and added that the city needs a vacant housing ordinance.

Public comments:

David Shireman, VP of the Firefighters Union said that as of 1/1/11 the number of people off will go from 4 to 3. This will help cut back on overtime.

Jameson Bledsoe first thanked the Mayor for setting up the forums and went on to discuss the demolition of houses. He asked if there were standards set to replace these homes. Many times the newer structures seem to be sub standard and out of place with the rest of the neighborhood. He also noted that if there is a house with the siding falling off this is not against code unless there is a hole in the outside wall. He also asked for the city to consider setting up a commission to establish more strict guidelines. Mr. Coffey stated that the Building Commission and Planning Commission should be sufficient to handle these matters.

The Ordinances and Resolutions:

G-10-14 Health Dept. inspection fees. Set up a standard annual fee for vendors at Farmers Markets instead of charging them for every time they set up. Passed 8-0. CM Caesar was absent.

G-10-15 Regulating the disposal of dead animals. Passed 8-0.

Z-10-02 Variance to change property on Grantline Rd. North of 265 from industrial to residential to accommodate the Struble family.
Passed 5 to 3. Mrs. Benedetti, Mr. Zurschmeide, and Mr. Gonder voted no.

A-10-06 Appropriation of $350,000 from paving funds from 2009 to establish handicap ramps. Passed 7-1 Mr. Price voted no.

R-10-15 Increase Housing Board by 2 seats.
Failed 2-6 All voted no except Mr. McLaughlin and Mr. Gonder.

As everyone knows, Monday is Memorial Day. Yes it is a good day for picnics and most of us get a holiday but we should remember what the day celebrates.

My father was a proud WWII veteran and he taught us about honor and love for our country. He always participated in the Memorial Day events with the VFW Hobart Post. He was very patriotic and taught us to be so also. He passed away over twenty years ago but he lives on in our memories.

So this Memorial Day please remember all of our service people those who are with us and those who have passed. And if you see a veteran or someone still in the service please remember to thank them.

The weather should be good for this weekend and all of the activities.

This Friday and Saturday there will be concerts at the Amphitheater.
This Saturday, start your day with a trip to the Farmer's Market to load up on great food.

After that Historian Dave Condra will be presenting a tour of Mansion Row.

REGARDING ST. MARY'S CHURCH

As a member of St. Mary's I must speak out. There has been a lot of outrage about the removal of the Bradford Pear trees along Eighth St. The "protesters" seem to be mainly non members.

First of all, the trees were not the right type to be planted in such a small area. They became too tall for the space and the falling leaves were lying on top of the church roof, causing damage. The trees on Spring St. were growing through the power lines. Additionally, the roots were encroaching on the water and sewer lines under the sidewalk and also damaging the sidewalk itself.

Yes, the steeple was taken down without the removal of any trees but it was cut into sections before removal and done under emergency circumstances. Duke energy would not allow the repaired steeple to be put into place from the Spring St. side because the crane would have to cross the power lines. The only solution would have been to shut down the entire grid during the process.

The only solution was to drive the crane over the sidewalk on Eighth St. and onto the side lawn. The trees were removed by St. Mary's and new more suitable trees will be planted in their place, also paid for by St. Mary's. The city was not charged a dime.

Irvin Stumler explained all of this at the city council meeting on May 20. He also attended every Mass over the weekend of May 22 and 23 and explained all of this to the church members. I talked to our church secretary after the 11:30 service and she said the calls made on the day of the tree removal were positive. Everyone understood the need for this and were glad that more suitable trees would be planted in replacement.

CITY COUNCIL MEETING 5/20/10

There was a lengthy but orderly meeting last night.

Carl Malysz started things off by representing the Mayor regarding the Greenway Project. There will be Federal matching funds if the city can provide approx. $1,225,000. It just so happens that there are funds left over from Phase 1 of the Scribner Project so it looks like we will have a walkway that extends past Loop Island and goes to Silver Creek.

Ed Wilkinson reported on the Sewer Board. He gave out reports to the council members showing the cash on hand in addition to the receipts and expenditures. He said the report was pretty straight forward since he is not a CPA. He added that the sewer liens are being paid but he does not have an exact amount now because the funds are being deposited in the bank. He promised more information later.

Although there were several Ordinances and Resolutions the rest of the meeting went smoothly for the most part. All members were present except for Mr. Caesar.

PUBLIC MEETING RE: RAMPS 5/20/10

The meeting took place before the regular council meeting and it concerned sidewalk ramps for handicapped people. Here are the hi-lights:

Must be built by the same contractor and not with new money. The ramps were funded by part of the two million dollars appropriated in 2009. $643,932 was carried over and after paying the final bill for Gohmann paving there was $350,00 left over. ADA mandates that the ramps be up to code.
CDBG funds cannot be used because CDBG is for low income properties only.
The cost of each ramp is between $1,000 and $2,000. There will be 300 to 400 ramps built.
There will be a list of all ramps, locations and cost furnished per Mr. Coffey's request.

I just read in the "Tribune" that there will be major cutbacks at Life Spring. This will begin in July due to changes in Indiana Medicaid.

Fifty people will lose their jobs and up to 1,500 patients will lose their coverage.

Personally I think this is a tragedy and I am so sick of cutbacks, I could SCREAM.

NO FREE TAP-INS FOR LINDEAN MEADOWS

First of all I want to say that I am in total support of the development of Linden Meadows. There was an article in the "Tribune" on 4/22/10 which explained that the Indiana Housing and Community Development Authority (IHCDA) will partner with a developer, Captains View LLC, to purchase and rehab 11 homes to resell.

This all sounded great until I read the part about the Sewer Board considering waiving the tap-in fees for these homes. The Sewer Board just received a large fee increase with another increase in two years. It is not fair to us, the citizens, to have an increase in our bills and watch a wealthy developer receive a free pass on the hook up fees.

The "Tribune" article also said that, "...the city will look to upgrade paving and drainage, as well as expand street lighting along Linden Meadows Court." The city will also "...implement a concentrated code enforcement sweep along Olive and Linden streets leading into Linden Meadows, and expedite the building permits and inspections for the development." This is a great gift to the developer in my eyes, this area needs better lighting and drainage and these steps will benefit the entire area around Linden Meadows. Enough is enough.

This past Tuesday, April 20, was Equal Pay Day. This means that women must work 16 months to make the same as men make in 12 months. So on April 20, we women finally made up the 22 cents of the dollar that we were short in 2009.

The New Albany Business and Professional Women Board of Directors (Kim Martin-Dawkins, Sarah Ring, Rosalie Dowell, Connie Enlow, Terri Tock, Suellen Wilkinson, Ann Windell and Suzy Higdon) had an excellent article in the Tribune this Tuesday and everyone should check it out.

COUNCIL MEETING 4/15/10

Hello everybody. I missed the first part of the council meeting last night so I did not get to hear the mayor speak. I heard that he told there were death threats. That is deplorable. I hope these people get arrested and convicted of terroristic threatening.

The bill that no one really wanted to pass did pass. Of course I'm talking about the sewer rate increase. Even the council members who voted for it said they did not like it but it was the lesser of two evils. Mr. Skomp said again how antsy the SRL is getting. He said their emails are getting pretty curt. He also admitted that if the city went into receivership our sewer rates could double. I don't like it either but we taxpayers paid this company to research and find the best solution for us. From what I understand they still need to pass G-10-10 which determines from which TIF districts the money will be taken. This meeting will take place on April 27. Since I have a prior commitment I will not be able to attend.

In other news, the position of full time attorney/grant writer passed the first two readings with 5 aye's (Ceasar,Benedetti, Messer, Zurschmeide, and Gonder), 3 nay's (Price,McLaughlin, & Gahan), and one abstention (Coffey).

Finally the whole council came together and voted unanimously to appropriate $100,000 from the Riverboat funds to demolish those 14 unsafe houses and buildings. All of us in attendance held our breath but thankfully the building did not fall on our heads.

That question was asked on this blog a few weeks ago. So I sent Mr. Etheridge an email with several questions regarding his bid for Mayor of New Albany. He replied with answers to all of my questions so I have posted them here.

Why are you running for Mayor? "I am running for Mayor of New Albany because I care and love this community and I want to get the city back on the right track for the future. Our city must move forward, no backward to achieve goals like fixing our sewers, revitalizing our downtown area and cleaning up our streets and neighborhoods. I am a common person with a common cause who has visions and goals for New Albany and is not in the race for just a paycheck."
What special qualifications do you bring to the position? "I bring 27+ years of Supervisory experience with the maintenance department of the Indiana Department of Highways. I have experience with the maintenance of our sewers and drainage on our roads. I am also a small business owner with management and budgeting skills."
How will you balance the budget? Or at least reduce the deficit? "Our city has a "control/spending problem" that needs to be solved to balance our budget. We need to eliminate non-essential positions within the city, reduce spending and find ways through grants and other sources to bring in more revenue to our city."
What will you do to improve code enforcement? "There should be a Code enforcement Office with a qualified code enforcement officer will deal with all code violations within our city. This person must be able to work hand in hand with the public and be experienced and knowledgeable of Indiana Law, city codes and ordinances. This person will also be assessable to neighborhood associations for their problems and concerns. Public outreach programs will also be established to help educate the public on codes and ordinances. The Code Enforcement office will work as a team with other departments to fix and solve the problems that are presented."
How do you feel about our sewer situation? What can be done to improve them? "As Mayor, I will look to revamp the current sewer situation. The 2009 flooding proved that our infrastructure needs to be looked at and examined closely. Preventive maintenance of all pipes, which has not been done by previous administrations, needs to be implemented. I feel that the Sewer Department which is currently outsourced to EMC, needs to be brought back inhouse and work closely with our Stormwater department as a team effort to handle issues such as preventive maintenance for all pipes in our city. I also feel that we need to look at a possible expansion of the Sewer plant by placing another plant on the wast end of our city to accommodate the flow."
Do you think the victims of the Aug. 09 flood are being adequately helped? What would you do? "I feel the flood victims have not been adequately helped. The management of maintenance of the pipe and ditches in our community were neglected throughout of the years. This needs to be done as a preventive measure daily, allocate money to fix the problems, and not just put a band-aid on the situation pacify the ones who were affected."
Do you think we have too many T.I.F.'s? "Yes, that statistics show that New Albany has more TIF's than any other city in Indiana."
What are your thoughts on revitalizing downtown? Do you think we need the 12 million dollar parking garage? "We need to revitalize our downtown before it becomes a ghost town. As Mayor, I plan to use the floodwall to attract restaurants and businesses, like our sister city Jeffersonville has done. Once this is established, people will utilize our downtown area, revenue will increase, businesses will flourish and downtown will once be what it was, a town that is alive. This city does not need another 12 million dollar parking garage at this time. We need to look at parking in the downtown area and work on other solutions instead of using our tax money."
How do you feel about changing Spring St., Elm St., and Market St. to 2 way? "Changing Spring St., Elm Street, and Market Street to two-ways would be a great idea for the flow of traffic into New Albany. The downside of this would be that these streets have been one way for so many years and changing these could cause more accidents. I feel that the city needs to look to see if it would be feasible to create this change."
What is your position on the Police and Fire Depts? Do you think 85% is too large a portion of the budget to be allotted to these departments? "85% of the city's budget is too large of an appropriation for public safety. Our Fire and Police Departments are crucial to our city and public safety, but as Mayor, I will look t the contracts, meet with the unions and see if an agreement can be made between the city and union on a feasible appropriation without hindering these very important city services. I will also look at each department so see if cost efficient measures can be implemented to reduce their budget. It is very important that the Mayor and the Unions work together as a team for the city of New Albany."

ALEX, I'LL TAKE PLAN B FOR $7.4 MILLION

After much discussion and even a short recess in the hallway Mr. Messer introduced and supported the Mayor's plan B for the sewer rate increase. He explained his vote stating that he voted the way he felt would be the best plan for the people and that he was not influenced by the Mayor. He said that they had not had a conversation about his vote or about his recent attention by the newspapers and TV.

The Ordinance has not yet passed. There was only a second reading tonight, with presumably the third and final reading at the next meeting.

Understandably there was a lot of opposition from the council and from the public. Mr. Gahan said that he did not see an emergency need to borrow the money and thought that we could finish these projects without incurring more debt. Mr. Coffey and Mr. Price concurred.

Again there were remarks from the public including Vicki Denhart who supported using more EDIT and TIF funds to keep the rates down. She also mentioned the unpaid hookup fees from Linden Meadows and wondered aloud how many other homes had unpaid hookup fees.

Joy Chism, a first time speaker said that she cannot afford the rate increase and blamed the sewer problems on mismanagement.

Rev. Steve Burks said that he has been a resident since 1997 and since then the sewer utility has been in constant crisis. He thinks we need clarity as to the specific needs because the city budget that he was given was very vague. He also repeated that the top city officials should lead by example and take a voluntary salary cut.

In other business:

A 10-02 - $300,000 Appropriation from Rainy Day to Stormwater passed 7-2

A 10-03 - $400,000 Appropriation from Rainy Day to pay claims and make improvements for
the damage caused by the August 4 flooding passed 7-2

A 10-04 - $75,000 from E.D.I.T. to stormwater passed 8-1

A 10-05 - $100,000 from Riverboat to demolish unsafe properties passed 9-0

G 10-07 - Ordinance regulating tattoo and body piercing establishments passed 9-0

G 10-08 - Ordinance regulating disposal of dead animals passed 9-0

Personally, I hate to see the rate increase for the sewers but if it means getting them fixed and people not having to worry about their basements flooding when it rains, then so be it. According to Mr. Fifer the "loan" of $7.4Mil. does not put cash in our bank account. It is only a draw which cannot be approved without strict documentation for projects. Mr. Zurschmeide said that the interest rates will never be lower and neither will the costs to complete the projects. I have to agree, contractors need work and so do the workers. Let's get these projects done and put our citizens to work.

The City Council will hear two different options tonight concerning the sewer rate increase.

Plan 1 calls for an increase of 18% now and 17-21% in 2012. This plan uses $700,000.00 from EDIT and Riverboat funds for the next 20 years.
Plan 2 calls for an increase of 23% now and 20% in 2012 and does not include the $700,000.00 from EDIT and Riverboat.

Mayor England first supported Plan 1 but changed his mind when he realized that EDIT and Riverboat might be needed to complete the Greenway project and the new Little League Complex.

I have expressed many times that I don't want to tie up EDIT for 20 years so I'm not in favor of either of these plans. We'll just have to wait and see what the council decides.

The Sewer meeting begins at 4:30 and the Council workshop begins at 6:00.

TAP IN FEES IN LINDEN MEADOWS

Yesterday's Tribune had an article about Linden Meadows.

It seems the Sewer Board wants to waive the tap in fees for three homes at $1,650.00 each. This was per the request of Carl Malysz because he does not think the homeowners should be penalized.

Although I agree that the homeowners should not be forced to pay these fees that Community Housing defaulted on, I think these fees should be added to the cost of the property and the new owner pick them up.

If a developer is interested in purchasing the property, $4,950.00 would not be a deal breaker.
They would already be obligated for the tap in fees for future homes at $1,800.00 each.

That way the city does not lose any more money and the current homeowners are not forced to pay another fee after all of the problems they have had to endure the last few years.

ALTERNATIVE TO THE ALTERNATIVES

I have been reading all of the information from blogs to the Tribune and everything I can find about the sewer rate increases and all of the "Alternative" plans. Instead of trying to weigh the pros and cons of each, I have decided to come up with one myself.

Take out the loan offered by SRL for the 7.4 million dollars.
Slash the annual budget by 1 million.
Collect all outstanding sewer bills, no exceptions.
Remove the 5-2 ratio and have individuals and developers pay the same rate.
Do not lower the rate per unit on high volume customers.
Remove the minimum of $10.08 and charge everyone according to usage.
Use TIF funds when ever possible to pay for equipment.
Charge impact fees and collect all other fees from developers where applicable.
After all of these steps have been taken, raise the sewer rate to cover the costs.

I did not list a particular rate increase percentage because I don't know if it would be 10%, 20% or whatever. I tried to find the most reasonable aspects from each plan and combine them into one. Now, before you start the barrage of comments, I admit that I am not a CPA, and really do not know much about all of this but this is what I came up with.

There is not much to report about the city council meeting tonight. The meeting lasted from 7:30 to 10:00 and virtually nothing was accomplished.

Everyone was tired of discussing the sewer rate increase and there was a lack of good information. To solve this problem the council decided to meet every day next week from Tuesday through Friday at 6:00. If the meeting room is not available another and smaller room will be used. These will be open to the public if space is available.

Mrs. Benedetti vowed to meet every night until a solution is found.

A DOWNTOWN PLAZA HERE? REALLY?

I just re-read Chris Morris' Tribune article about Jack Bobo's bid to purchase land downtown to build a new plaza aka. Scribner Place Phase II.

I know the plans included a parking garage but nothing was mentioned this time about the city kicking in $12,000,000 to make it happen. Maybe Mr. Bobo and Mainland Properties LLC realized New Albany didn't have that kind of cash lying around.

Mr. Malysz promised to go over the plans "with a fine tooth comb", but it still makes me wonder why a company would want to invest over a million dollars here and now. Do they know something the rest of us don't?

At any rate the thought of a massive building project with all the jobs that would come with it sounds like a dream come true to me. I just hope they can work things out with the EPA.

TO FLUSH OR NOT TO FLUSH

Tonight's meeting lasted about 2 1/2 hours with a lot of talk and not much progress.

I was not present for the sewer board meeting at 4:00 but the main topics were briefly explained in the 6:00 meeting with the City Council. All of the council members were present and everyone expressed their opinion. Some more loudly than others.

At the beginning; Mr. Malysz discussed a memo from the Mayor which stated that the Administration is in the process of talking with EMC about terminating their contract as soon as possible instead of letting it continue until 2012. Mr. Ceasar suggested that a Sewer Board member and a Council member be included in these meetings so everyone can stay updated on the progress. Mr. Malysz seemed to agree.

Mr. Skomp of Crowe Horwath kept telling the council that time is running out and the city needs to act now! He and Mr. Fifer, sewer board attorney, kept stating that the city is in dire straits and we need to accept the offer from SRF (State Revolving Financing). In essence the state is offering to re-negotiate our bond interest rate from around 3.9% to 2.5%. He said if we don't hurry and sign the agreement the EPA will take over our sewer utility and charge whatever rate they want. Scary stuff.

I feel that we are being rushed but then I remember that the firm of Crowe Horwath was hired by "us" and so their loyalty should be to us. In other words they should have our best interest at heart.

There were nine citizens who spoke at the podium with various messages:

David Andrews from Georgetown said that the New Albany Council has a difficult job setting rates for citizens who vote for them, and added that Georgetown has committed to the 36% rate increase.

Cat McDaniel, a 30 year New Albany resident and businessman said that the city is delaying in fixing the problem because it is cheaper to hire a consultant. He added that previous councils did not make the hard decisions and raise rates gradually.

Nancy Morton a resident in the County Line Rd. area said that she and her neighbors have cut back as much as possible.

Vicki Denhart, a New Albany resident, asked Mr. Skomp where his company got their numbers for their report. He replied that they did a review but not a full audit because it was not necessary. She added that EDIT and TIF funds should be used, and that a forensic audit was needed. She also stated that tap in fees and permit fees should be raised so the developers would pay their fair share.

Steve Schmeltz said he always complied with rate increases and purchased necessary sump pumps, etc. but this rate is just ridiculous. He asked where the funds had gone, and that millions of dollars had gone for naught.

Marilyn White, a resident of Powder House Lane, was confused because she pays her water bill to Edwardsville and her sewer bill to New Albany. She also has a flat rate rather than a rate based on consumption. Mr. Fifer and the sewer board promised to look into the matter.

Kay Hartman owns apartment houses in New Albany and said that if she ran her business like the city officials run New Albany she would have been out of business years ago.

Greg Reitz questioned why a household of three people would have a $70.00 sewer bill.

These people are just examples of the population and how distraught everyone is.

I don't want my sewer bill raised either, but I don't think EDIT should be used to pay to keep the rates from being raised. That would unfairly raise the rate for the taxpayers and not the businesses. Kroger, Walmart, Target, Kmart etc. do not pay EDIT. Taxpayers may lose their jobs and therefore EDIT would go down but these big stores are here to stay. Let's let them pay their fair share of the sewer bill. Yes, I know the fee would be passed on to the shoppers, but we can control how much we shop but we can't control how much of our taxes go to pay for sewer bills. I also agree that tap in fees should be raised. Yes I know the developers will pass this along to the home buyer but everything else is included in the price of a home, such as materials, so the price of a new home may be affected but not by a great amount.

Bottom line, the residents of New Albany and the fringe areas are doing the best they can. People can only cut back so far.

STATE TROOPERS ON MARKET STREET

There was a discussion started on the last posting about the Tribune article concerning Indiana State Troopers patrolling downtown New Albany.

For the record I believe that anyone who drinks or uses any drug that hinders their ability and drives deserves to be pulled over and dealt with according to the law. And I do not believe anyone is above the law.

I can't help but wonder why the State Troopers find it necessary to patrol the streets downtown. In my opinion it makes it appear that our City Police are not doing their job. That bothers me a lot. I know our local police are patrolling all areas of New Albany, I see them all of the time. I know the Chief said he appreciated their help but frankly I think the State Police are better utilized patrolling the expressways and areas outside of the city.

And I feel that patrons of Studios and other downtown establishments may feel that they are being targeted. Even if a person has not been drinking the sight of a police car following them makes them feel very uneasy. I'm sure we all have had this feeling.

We are trying to build our downtown and we need patrons of our establishments. I wish the State Troopers would patrol the areas outside of the city and let our local police do their job.

SHORT BUT NOT SO SWEET

There were only two items on the agenda tonight, so our city council meeting only lasted about 40 minutes.

The items in question were: G-10-02 Ordinance Establishing a Full-Time Common Council Attorney. There was quite a bit of discussion both pro and con. Mr. Coffey and Mr. Price both stated that they had nothing against the candidate but with the city budget in the condition it is they did not see a need for a full time attorney at this time.

Mr. Gonder did not believe that the city was served by a part time attorney. He mentioned all of the questions about the sewers, cleaning up the ordinance book, and people questioning our local government's integrity. He added that there is a need to search out ways to utilize the attorney.

The ordinance was voted down 5-4 with Mr. Coffey, Mr. Price, Mr. McLaughlin, Mr. Gahan, and Mr. Zurschmeide voting against.

The second agenda item was R-10-06 Resolution To Purchase Garbage Lids, and Lid Replacements along with Installation of New Lids From The Riverboat Fund. Mr. Malysz said the Mayor had requested this item be added to the agenda. There was discussion on this issue also but after establishing that the city owns these cans and is obligated to maintain them the resolution passed with a show of hands.

During the comments from the city officials, Mr. Malysz mentioned that the Mayor is interested in re-establishing a Human Rights Commission since there have been a few issues in the past couple of years that would warrant such. Sounds like an interesting idea to me.

WHERE CAN I BUY A GIFT BAG IN THIS TOWN?

I attended a birthday party at the Knights of Columbus Hall last Saturday. Someone at the party had forgotten to purchase a gift bag and could not leave the party. She asked me to run this errand for her.

I started down Main St. toward downtown thinking it would be a quick trip. Why everybody sells wrapping paper and gift bags, right? Wrong. As I drove down Main St. and then State St. it occurred to me that we don't have a drug store or a card shop downtown at all. I ended up driving to the Dollar Tree for my purchase.

After returning to the party I had a discussion with another lifetime New Albany resident about the stores which we shopped in as children and young adults. We recalled W.T. Grant, Woolworth, Wallgreens, The Fashion Shop, The Joy Shop, even the Dollar General Store.

We need a "big box" store or at least a grocery store downtown. I'm not saying we need to put a Walmart on Pearl St. but we need some sort of store where a downtown resident could walk to for the purchase of an aspirin or a gallon of milk, or even a gift bag. We want people to live downtown and be able to walk to a store or restaurant. Many people are taking the risk to open a new business and I applaud them. But will someone or group of partners with means please open a "general store" where people can purchase the basic items for day to day use. The specialty stores are great but sometimes we just need a gift bag.

CITY COUNCIL MEETING 2/18/10

We had a long and not very productive meeting last night and I will give a brief outline. My report will not be nearly as detailed as Mr. Baylor's.

There is a new format for the agenda. The public officials now speak before the general public. Mr. Carl Malysz spoke first in the Mayor's place:

He had a note from the Mayor which asked that two of the agenda items be tabled. A-09-22 the $2,000,000 for the police and fire depts. from EDIT and G-10-02, the full time attorney for the council. Mr. Ceasar was the sponsor and he complied with the Mayor's wishes.

Mr. Malysz went on to address the comments made at the 2/17 town hall meeting. He said that since Jan. 08 there have been 5 overflows from the sewer system due to the weather. He added that EPA thinks more needs to be done to address this. He also said that even when the Mayor is on vacation they talk daily, sometimes even more.

Chief Juliot (Fire Dept.) was next: he had good news concerning a grant received from Sen. Lugar in the amount of $700,000 to be used to upgrade the communication equipment. This must be shared with other Southern Indiana counties but our share amounts to approx. $180,000.

Mr. Price asked for a public hearing before a vote is to be taken on the sewer rate increase. Mr. Messer said the ordinance needs to be read and a vote taken before Mr. Skomph (from CroweHorwath) can share the details of his meeting with the bondholders and SRL (State Revolving Loans). After the first reading and the first vote, 7 nay no aye, he (Mr. Skomph) shared that the increase was down to 36% now and 19% in 2012. He stressed that immediate action needed to be taken and that he had never seen the government so amiable to an agreement. A meeting was scheduled for March 11 @ 6:00 for the people to express their opinions.

Next were the communications from the public. And of course many people spoke. I will not go into detail but most expressed the same financial problems as those speaking at the town hall meeting. A couple firefighters asked that A-09-22 be passed, not just to save their jobs but for public safety as well.

Finally two resolutions were passed 7-0, R-10-15 a Resolution having to do with L & D Mail Masters, and R-10-06 the Resolution requesting a Forensic Audit. This is being paid for by the Police and Fire Unions.

The fun ended around 9:45. Many people were in small groups in the hall having discussions.

TOWN HALL MEETING 2/17/10 FIRST OF A SERIES

I arrived at the Town Hall meeting about 25 min. late. Mr. Coffey had already done his presentation and he had just opened the meeting for public comments.

And comment they did! Many people expressed great concern over a 70% sewer rate increase. One lady said she would have to close her business after 30 years and move to Jeffersonville. A young woman said she just purchased a home and had to work three jobs just to make ends meet. And there were many similar stories.

There was a lot of interesting information given: in the years 2008 and 2009 there was only $69,738.06 collected in sewer liens, per Vicki Denhart. This seems like a small amount considering the huge amount that is owed. Personally I think the city should go after the business owners who owe thousands instead of just the property owner who may owe much less. But every dollar helps.

Mr. Coffey also asked everyone present to attend the council meeting tomorrow night (2/18) and speak in favor of the forensic audit resolution. There should be a long list of public speakers.

It was also mentioned that the previous audits are available on the indiana.gov website, look under "State Board of Accounts", then "audits" then "Floyd County" and then "New Albany". It may take a minute but it should be worth while.

Pat Harrison said that she had spoken with Rep. Ed Clere this evening and he said that he has found a way to reduce the increase to 35%. She said he did not elaborate so there were no further details. That helps but it's still a big increase.

There is another meeting scheduled for April 6, 2010. I don't know the topic but it is sure to be a lively discussion.

Patty Walker is having a Valentine breakfast at Applebee's on Grantline Rd. this Sunday from 8:00 to 10:00. Warm up with hot pancakes and coffee and it's just $5.00, can't beat a deal like that. Patty is running for re-election to the Township Advisory Board.

I have read the "Tribune" article from February 8th about the 20 firefighters who could lose their jobs. It was very well written, thank you Daniel, but I am still confused.

If the city has 4 Million Dollars a year in unencumbered EDIT funds this year and presumably in previous years, why are we in such trouble?

We don't have the money to fix our sewers, potholes, sidewalks, etc. but we have all of these unencumbered funds?

As Denzil Washington said in the movie "Philadelphia", "Please explain this to me as if I were a five year old".

I don't know about you, but I am getting a little tired of hearing about how "dirty" and "ugly"New Albany is. Neighborhood groups have had cleanups and several people have "adopted" a corner to keep them cleaned up. Are just a few people trying to clean things up and the rest going back and making a mess?

Mr. Lopp has said that he has wanted a Cracker Barrel located near the I-64 exit for 16 years. I had heard rumors about this for the past few years but never knew why it didn't materialize. Has he informed the Mayor's office and our Code Enforcement Officer? Has he made a public plea to the residents? Has he considered hiring a crew to make this area more attractive?

He also complained about the condition of East Spring St. where people arrive from Clarksville. I wonder if the East Spring Neighborhood Association is aware of this?

I think we have done a lot to make our city more attractive in the last few years. And yes, a large retail chain store would probably bring more traffic to downtown. I hate the thought of these hard working small business owners going under for lack of customers. I don't see the need for a chain restaurant in our downtown though. It seems that it would take business away from our locally owned restaurants.

Obviously I don't have the answers but I would love to know what we can do to keep our city on the path we have started and to become the great city I know we can be.

COUNCIL MEETING 1/21/10

The agenda has changed since the last council meeting. Now the Mayor and city officials speak before the general public.

Mayor England began by thanking Mr. Coffey and Ms. Benedetti for their service as President and VP during 2009. He then congratulated Mr. Gonder and Mr. McLaughlin on their elections as President and VP for 2010.

He then got down to business discussing the possible closing of a fire station and/or laying off personnel. He asked the council to schedule a work session for Febuary 5, a Saturday, to discuss the $2,000,000 appropriation for the fire and police depts. before they have a final vote.

He then advised that the State of the City address will take place in March. There will be a press release also. Additionally there will be a press release concerning the 6.7 million for the SEJ rehab. The city plans to tear down 40 dilapidated homes and use 10 lots already owned and build 50 homes. The plan is to sell them for $120,000 to $130,000 to single families. They cannot be purchased for investment ie. rental property.

During the city official discussion Mr. Price said that the 5.2million borrowed from the Sewer Utility needs to be paid back before the sewer rates are raised. Mrs. Garry advised him that the loan was paid back in 2004. He also questioned the Mayor's comment that the police and fire dept. are underfunded, he said a union representative told him they had received a better contract than they had requested. A representative from the fire dept. said they received a raise of about $6.80 per month more than they requested and the police received the same.

During the comments from the public several people asked for help from last year's flood. Some people said the city had made promises which were not kept. Mr. Caesar said the Stormwater Board will meet next Thursday 1/28 at 10:00 to reveal the preliminary master plan to address this problem. Attny Shane Gibson spoke before the vote was taken on the $400,000 appropriation and asked that their be an amendment to give at least $200,000 to the Stormwater Board to dredge creeks and fix the culverts and other "micro projects". The amendment was passed 9-0. The final vote on the appropriation was 8-1 with Mr. Price voting against.

As of yet, the council does not yet have a full time attorney. The ordinance was tabled until a committee could meet and work out the details.

At this time it was 9:30 and I had to leave since I work early in the morning. If anyone stayed until the end please give us the details of the rest of the meeting.

SAVE OUR TOWNSHIPS

There have been two recent articles in the "Courier-Journal" about eliminating Township Trustees and the Advisory Board. This is another one of Daniel's ideas for "reform".

I have never worked with the Township Trustee's office but I have volunteered at Interfaith and have seen many people apply for help with their utility bills. These people visit the Interfaith office on a daily basis. Interfaith is limited to the amount they have to help these people and often refer them to the Township Trustee's office.

If we did not have a Township Trustee or Advisory Board (who determines the budget) where would these people go for help? The CJ article said they would be referred to "county government" whoever that is. It looks like the poor would be given the run around again, just like when they call the "Welfare" office for help with ADC payments or food stamps.

You can bet that these legislators, especially Rep. Bill Crawford, the author of this bill, has never had to apply for benefits or assist someone who has. I must agree with Rep. Craig Fry who said , "I think this is a horrible public policy." And tell Rep. Crawford that his idea, "This lets the people decide" and "This is about governing with the consent of those governed." is flawed because if the bill is worded as poorly as the one regarding the Township Assessors many will not understand it and will not vote the way they intended.

Let's not let Daniels win on this one. Please vote to keep our Township Advisory Board and Trustees. Don't let our disadvantaged citizens get the shaft again.

What is Tax Increment Financing?

"Tax Increment Financing (TIF) allows cities to create special districts and to make public improvements within those districts that will generate private-sector development. During the development period, the tax base is frozen at the predevelopment level."

and from the Ohio State University Extension Fact Sheet ( I know but it also applies to Indiana)
"...the TIF program enables counties, municipalities, and townships to exempt from real property taxation the new value added to a parcel or group of parcels as a result of new property investment. Unlike the EZ program, TIF can be used with residential development. Another difference involves the exemption associated with a TIF. The EZ program abates taxes, whereas TIF does not change the taxpayer's tax liability or the valuation of the taxpayer's property. Instead, TIF enables the taxpayer to make payments to a special fund in an amount equal to the property tax liability. These payments in lieu of taxes are used by the local government to retire debt incurred for in infrastructure improvements needed to support the new real property investment."

From what I can determine it works like this: a developer purchases a plot of land, the city improves the property with roads, utilities, etc. and the developer's property taxes are put in a special fund to pay the city back for their investment.

I can see how this helps with improvements to the city and how it benefits the property owner (developer). I can also see the other side which is a decrease in the amount of property taxes collected.

So, in other words, do we help to improve property at the risk of lower taxes collected? Or do we wait and hope that the property is developed anyway and collect the whole amount of property tax based on the property after improvements have been made? hmmmmmmmmmmmm

FIRST COUNCIL MEETING OF 2010

The meeting began with a quick race for Council President, Mr. Price nominated Pat McLaughlin and Mrs. Benedetti nominated John Gonder. Mr. Gonder won 5-4 with Benedetti, Messer, Zurschmeide, Coffey, and himself voting for him. Mr. McLaughlin got the silver medal as VP.

After the committee members were appointed and/or voted in, the next order of business were the public communications. The parking permits were the main topic tonight. Jameson Bledsoe, Randy Bulleitt, and Vickie Nugent, all Uptown Neighborhood residents spoke in favor. They all discussed their own parking problems and said they would pay to have a designated spot in front of their homes. Randy Smith said he lives on the narrow part of Elm St. He questioned the the idea of having 20' per space considering some lots are only 35' wide. The council voted and decided to sent this Ordinance to committee.

There were a few issues discussed during the city official communications. Mr. Gahan said that A 09-21 (the $400,000 for the flood victims) would be back on the agenda for a 3rd reading at the next meeting.

Mr. Malysz, speaking for the Mayor, urged that A 09-22 also be added to the next agenda (this was the $2,000,000 from EDIT for the fire and police).

said this will be reviewed by the Rules Committee and the Mrs. Benedetti asked for a prompt decision on hiring a new attorney for the council. Mr. Gonderrecommendations will be considered by the council. Mr. Coffey stressed that a Floyd Co. resident will be preferable.

There was also much discussion on Resolution 10-01 concerning the Coyle property. The city has already spent approx. $50,000 for appraisals and an enviromental study and enlarging the TIF area will help to recoup these funds. This also has been sent to committee.

This is a very short summary but the meeting ended by 9:00 with no fireworks. But the year is still very young. Stay tuned.

I thought about making the usual New Year's Resolutions but decided to list New Year wishes instead. They are listed in no particular order. Just wishful thinking.

For everyone to have health care, not the expensive kind with high deductibles, but the kind that pays for everything, like all of the other civilized countries have.
For everyone who needs a job to find a good one. A job with a living wage and good benefits.
For everyone to have a clean, safe home which they can afford.
For New Albany to have working sewers and stormwater drains.
For New Albany to repair all of it's unsafe and dilapidated homes.
To have the Greenway project finished so everyone can walk along the riverbank safely.
For the K & I Bridge to be opened for pedestrians.
For the continuation of the revitalization of New Albany's downtown, including the Main St. Master Plan.
To end the war in Afghanistan and bring our troops home.
For people to quit trying to take "In God We Trust" off of our currency.

I am very disappointed after last night's council meeting. The first item on the agenda was the resolution for the $400,000 to help the flood victims of last August. Jason Hublar and his wife Crystal told of how not only their possessions but the school supplies they purchased for their students were lost. Not only that but they had to take out a loan to cover their loss.

My own brother-in-law and sister-in-law also will be forced to borrow to pay for the repairs to their furnace. I had assured them that the city would take care of them and secured the forms for them to complete and send to Shane Gibson. I have not talked to them yet but they subscribe to the Tribune so they will find out. They are both retired so money is tight, but oh well, that's the way it goes.

I want to thank Shane Gibson, Jeff Gahan, Pat McLaughlin and Dan Coffey for their efforts. These gentlemen spoke about the people who have been devastated by the flood. The rest of the council wanted a long term fix. Mr. Gibson wanted a long term fix also but he knows the people are hurting now. He wanted to reimburse the applicants for their loss and use the rest of the $400,000 for fixing the creeks and ditches. Made sense to me.

Also on the agenda was the request of an appropriation for $2,000,000 to fund the police and fire departments. It was decided to postpone the vote until there was more investigation.

The vacant Trinity Plaza building on the corner of Daisy Lane and Green Valley Rd. will be used as a furniture store for two years. The Planning Commission hopes that by that time a medical facility will replace the furniture store.

And last but not least the $300,000 loan from the Rainy Day Fund to the Storm Water Fund was passed. It was also decided that after three years the Storm Water Fund needs a audit.

LET'S BUILD THE YOUTH SHELTER FIRST

There was an article in Saturday's Tribune about the proposed baseball and softball complex. This "Field of Dreams" as it is called would be built behind Home Depot and cost $10 million dollars.

I must agree with Councilmen Messer and Price that this is not a high priority. Yes our children need such a facility but this need is not urgent, I consider it more of a want.

Want we need to do is get off of our collective behinds and build a youth shelter. Our children are living in conditions that I'm sure none of us would want to live in. They are there because conditions at home are even worse!

These are our (Floyd County) children also. And although they may benefit from the "Field of Dreams" also, they need a decent place to live first. I cannot understand why they are made to wait. A new home for our kids would cost a lot less than 10 million, and this is a high priority.

Please, New Albany and Floyd County, won't you work together and make this happen?

HELP IS ON THE WAY

The meeting with the victims of the August 4, 2009 flood was held last night at the Library to a fairly thin but enthusiastic crowd.

At the very beginning it was stressed that the city could only help city residents, not Floyd County or fringe residents. Mr. Coffey suggested that residents who fall into this category speak to the County Commissioners. He also added that their would be no discussion about the long term solution for fixing the sewers and drainage systems. The council and administration were there to help the immediate need of the city residents.

Shane Gibson, City Attorney, was also present and stressed that Tort Claims need to be filed immediately to be considered for help. He, the mayor, and the council are optimistically hoping to resolve this before Christmas or at least by the first of the year.

SAVE OUR HISTORICAL SITES

As promised, I attended the first meeting of a new group which is unnamed at present. We had a good crowd to start with, several people who are active in the community. The facilitator was Steve Pacciano, and he is very knowledgeable on the history of Indiana, Floyd County in particular.

Other attendees included, Rep. Ed Clere, Greg Sekula of 1 So. In., David Barksdale, County Historian, Carol Tobe, Save Our Knobs, Judy Martin & Laura Reynolds of Historic Landmarks, Vic McGinity of F.C.Historicl Society, Don Lopp, and Adam Dickey, Baron Hill's Representative. There were others also but these people were singled out by Steve.

The main focus tonight was to establish that a separate entity is needed for preservation. The group listed nearly 20 organizations already involved with preservation in one way or another. But none of these groups really fit the bill as an education resource or watchdog. So it was decided that a new non-profit organization is needed.

A committee of five people, sorry I did not get all of their names, will write the mission statement and report back to the rest of us on Feburary 2, 2010. Please save that date because we want to get more people involved. New Albany has already lost many historical sites and we need to keep the ones we still have.

I hope everyone is having a good day off. Unlike John Gonder this shopper is staying home. We had two wonderful Thanksgiving Dinners yesterday and I didn't have to cook either one, just made about a dozen pies.

Happy Post Thanksgiving everyone, be safe if you are out there fighting the crowds. And happy bargain hunting.

I just want to wish everyone a Happy and Safe Thanksgiving.
If you are on the road, please be careful.
If you have enough to eat, please remember those who don't.
And most of all, please remember our troops who are spending Thanksgiving in a far away country and are not able to spend Thanksgiving with their families and friends.

THURSDAY'S COUNCIL MEETING

There was a packed house Thursday night for the city council meeting. There were even three former council members in attendance.

The meeting started off with comments from the public of which there were several. It started off with Mark Cassidy who surprised everyone, including himself, by supporting Mr. Price in the resolution to rescind health insurance benefits for council members. I echoed his words when my turn came, all to no avail as we all know. Thankfully I heard that the cost of living bonuses will be given to the non-bargaining employees of the city. That was my other topic.

Richard Berryman was next and was happy to report that the city cleaned up the mess they made in front of his house when a garbage truck leaked. His main topic was FEMA's decision to deny the flood victim's claims. Mr. Coffey explained that New Albany was included with the rest of the county which did not have as much damage. Doesn't seem fair.

Next up was Vicki Denhart who used her five minutes wisely and covered several different items. She stated that the nearly $44,000 fee for health care should not be given to a select few but rather spread among the rest of the council. She also said that Mr. Malysz and Mr. Rosenbarger had written grants in the past and with their large salaries should be required to do so in the future and thus eliminate the need for a grant writer. She also went on to speak about the lack of accountability and lack of leadership in the city, she ended with the words "We're in trouble".

Jason Hublar also spoke about the Tort claims being denied. He said the reason given was that the city was unaware of the flood problems before the big flood according to the insurance company, Midwest. He added that he and others had made the city aware of these problems two years ago.

Scott Thomas and Bob Lind spoke against the moratorium on building permits. Mr. Gonder changed the agenda to include just the first reading so the Ordinance can be changed again.

Ray Ballew spoke out about the healthcare rescinding resolution. He said the three part time employees are all business people who should be able to afford their own insurance, he also thanked Mr. Price for writing the resolution.

The last citizen was Debbie Pellman (sp?) who wants our tax dollars to help the flood victims. She asked that citizens be put first for once.

Mr. Malysz handed out a memo from the Mayor to the council (I just happen to have a copy).
It is regarding recent England Administration accomplishments. They include:

ARRA Stimulus Funding $1,515,000

Spring St. signals
Market St. signals
Hausfeld Lane/CSX RR crossing
State St. pavement (Green Valley Rd to I-265)

McDonald Lane design $630,000 contract 80% Federal - from Charlestown Rd To Grant Line Rd.

Mt. Tabor Road Design $482,750 contract 80% Federal also C-town to G-Line Rds.

Ohio River Greenway City $350,000 (from TIF) the Corps of Engineers $350,000
Additonal $3.2 million ARRA Stimulus funding from Corps of Engineers, New Albany will need to match this funding by June 2010 or the Corps will lose it.

The SEJ/East Spring Neighborhoods NSP Project - the $6.7 million grant to improve 40 properties, an additional 10-12 houses will be constructed.

The city is also in the process of selling the Baptist Tabernacle and Shrader Stables.

All of this happened between 7:30 and 9:00 Thursday night. There is so much good news but still so much bad news also. There is a light at the end of this tunnel but we have a long way to go to get there. I just wish someone could wave magic wand and create good jobs for our citizens so we could pay our bills and not worry about losing our homes. Those 40 houses will be sold to people with lower to moderate incomes but people need to have an income to buy them. Let's hope and pray that something happens soon.
