CITY COUNCIL MEETING 9/3/09 TABLE THIS, TABLE THAT

The September 3 city council meeting was pretty tame. The Moratorium Ordinance was tabled as was the Ordinance concerning raising the user/service fees for trash pick up. However, Mr. Messer's amendment passed. This lowered the proposed monthly increase from $5.00 to $2.00.

On a happier note, the cost of living recognition passed 8-1 on the first reading. This is the Ordinance giving the non-bargaining employees a one time wage adjustment to make up for the lack of a salary increase in 2 years.

Mr. Coffey formed a fact finding committee to look into the idea of a moratorium on building. It seems there was a question as to the legality of such an ordinance. The committee will be composed of three council members, John Gonder (chair), Bob Ceasar, Kevin Zurschmeide, two attorneys, Stan Robison and Shane Gibson, three developers and one of the engineers from the Storm Water Board. Mr. Gonder wanted one of the victims of the recent flooding added but Mr. Coffey said this was only fact finding and the public input was already on record. The results of the meetings will be presented at a public meeting, where the citizens can give their opinions.

At the end of the meeting a business owner spoke during the non-agenda public communications. Her first name if Vickie (sorry I did not hear her last name). She has a hair salon on 15th and Spring and the empty lot next to her has large sink holes which caused her basement wall to cave in. Very scary indeed. Thankfully Mr. Price and some of the other council members will contact the storm water board to see what can be done to help her. This is in spite of the fact that the problems are on private property. Thank you Mr. Price for helping this citizen. In my opinion that is what our city council is supposed to do.

Finally, Ordinance G-09-19 failed 6-3. This was the one which gave Georgetown 5 years to pay on their agreement.

On a personal note, I want to thank the council and everyone for conducting the meeting in a businesslike fashion, hardly a voice was raised.

what did he write a letter about? of all the things about which coffey could have written, this is the most important? obviously it is.

I agree that it would be nice to have more letters to the paper regarding council’s positions on agenda items.

I would find them more enlightening then most current columns.

As for you can't make this stuff up
You should go to "other" blogs because their rendition of what occurred is quite bias if not untrue.

Personally, I feel, Planning, Zoning, Redevelopment, and the Stormwater Board SHOULD HAVE TO WORK HAND IN HAND, with ALL signing off on any types of development. Taxpayers should not have to foot the bills for the Developers. Use what we have and just put the laws in place we need.

10:17 Thanks to Ms. Bolovschak we once had that. But for those interested, you can obtain a cd or cassette tape copy of the August 20council meeting like we did.

remembercharlemagne, they can spin it anyway they want, but the 75-100 people who attended that August 20th meeting has family, co-workers and friends who was told the truth.

They were all witnesses to the event.

Ask yourself this:

Why is our local newspaper NOT reporting the meeting event of Aug. 20? Are they bias or is England up to his old tricks?

They can spin their lies of the event, but the truth will come out.

Why wasn't 50 arrest at the beer walk NOT reported, and that local NAPD had to call in the State Police for help?

You call that a success?

Is that NOT bias reporting or a cover up?

No wonder they send the newspaper by postal, they are on the verge of bankrupcy.

I am not a big fan of Mr. Coffey,but I applaud him for writing the letter to the Tribune.You see myself and my family attended that Aug.20,2009 council meeting for the first time.We were really astonished at the rudeness and belligerent behavior of Roger Baylor!
There was a lot more went on then what Mr. Coffey mentioned. The lady at the podium was rudely interrupted several times. Mr. Smith you have your facts wrong,quit trying to sugar coat what really went on!
What myself and my family heard was the lady said,she did not want edit money taken out of her paycheck to pay for sidewalks in front of a pizza place,sidewalks and a patio in front of a bar. She would rather see her edit money that comes out of her paycheck to be used for the storm water flooding and sewer flooding over flows instead. I applaud the lady at the podium,I also agree with her.
We really give credit to the council member that said,"that is enough." I will question however,why the mayor,city attorney,and the rest of the council members were too cowardly to step up to the plate and say something to stop her from being harassed by this man. We were there,witnessed and heard the whole thing.

The trouble is, no EDIT money went to sidewalks or patios at a bar. That was a lie and the council, including Mr. Coffey, was aware of it since they are the only ones who can approve EDIT expenditures.

The officer asked me if it was worth being arrested for disorderly conduct, and I replied that yes, if being arrested might provide the opportunity to prove that Prof. Erika lied about my business then yes, it might be worth it. But I do thank both of you commenting here today. I needed a laugh.

Why can you people just not let it go?
First of all, you know Roger is not the ONLY owner of the business, secondly, who really cares? They are bringing in money, and visitors to downtown, which benefits us ALL here in town.
This persistant crying and whining about everything they do at bank street brewery sounds more like a two year being jealious because someone elses toy is better than theirs.
For Christs sake, we get it all ready. You hate Roger, you hate anyone who has ever agreed with him, you hate the mayor, you hate the police, you hate having to pay your fair share of taxes, you hate everything about his city for the most part.

i don't know if or when the board of works gave its a piece of paper expressing permission to put the wall in place. i do know that the city extended the sidewalk FOR THE PURPOSE of being able to walk around something a wall.

if someone else wants a sidewalk, go open a business, attract people to new albany, pay the extra taxes associated with such, and the city will give you a sidewalk.

the sidewalk looks nice. new albany is full of stuff in public rights of way that just does not belong there. how many signs did i see yesterday for todd coleman's labor day sale? how many were on the median? how many coke machines are on sidewalks? if the faux citizens equally bitches about all things in the right-of-way, i'd say she cared about stuff in the right of way. since the faux citizens only bitch about roger's wall, then i think she just doesn't like roger.

Driving through N.A. this morning on my way from my floyd county office, to my Clark county office, and it would appear, Captain Anonymous, that there are bigger problems that your pet retaining wall.
If you want to get angry about something, get angry about the mountain of garbage over flowing out of the city can at the bus stop on State and Elm. Gte angry about the fact that hardly a telephone pole in the city isnt covered "prescription assistance" posters from the business pet store/ prescription import company on spring at Beharrel.
Get angry about dead or over grown trees along east spring street, tho over grown trees creating a visual obstruction to people trying to pull out onto spring from Jay or Thomas.
There is so much ugliness in our city, so much blight, and you choose to focus your energy on what is actually an attractive and visually pleasing 25 foot stretch of side walk in fron tof a successful popular business.

And as I side note, I still havent been able to find any official record of 50 arrests from the pub crawl, nor could I find any documentation of NAPD having call in the State Police for assistance for the unruley mobs.

Through the discourse we have been able to read here, it is readily apparent that the anonymous poster who perpetually shows that their hypocrisy knows no bounds, fully subscribes to the quote listed above.
The blatant ignoring of pertinent issues that face this city, in favor of picking certain issues, that only have relativity based on who is involved (mainly Baylor, England, or the NAPD), clearly illustrates to me that the reported followers of CFA and FOS are NOT interested in bettering this city, but instead of advancing their own agendas of fulfilling personal vendettas.
Making outlandish claims of DOJ and FBI investigations, and making such claims publicly, to wit there is never a shred of proof offered, nor has any reports come out. A prime example of this would be the allegations of 50 arrests by the ISP, after NAPD had to call in the State to help control the mobs of people on the first inaugural bar walk in NA. If we look at that allegation, we quickly see that two other players were involved, Baylor and Mayor England.
These are deliberate and well calculated attacks on these peoples characters. Think of it as a defense attorney in a trial making a horrid statement, knowing full well that the judge will uphold a objection by the prosecution, the actual act is struck down, but the seed is planted in the minds of the jury, this is exactly what is occurring here.
By remaining anonymous in the postings, the author of these postings knows full well that they will not cross the line that will warrant subpoenas to pull the IP address, tracking back to their computer, but the postings are bad enough to seriously damage certain individuals reputation, character, and apparent trust-worthiness.
By repeatedly committing these character assassination attempts, the anonymous poster is illustrating just how sick they actually are. In a world where they feel personally wronged by the slightest transgression that is not immediately and resoundingly dealt with by way of a jail sentence or a hefty fine. Yet in the same breath, the anonymous poster decries every faction of city government, with the exception of CM Coffey, and CM Price, which incidentally those two, and occasionally CM Gahan, are known combatants of Baylor, and often clash with Mayor England and his administrative staff.
The consistent abuse of statistics, bent to a form that no longer is recognizable at what is originally was, the twisting of a privately written letter to an office that soon becomes a “full blown” investigation by the authorities, it is merely a subscription to the adage “any story told often enough, is eventually accepted as truth”, and the anonymous poster knows this.
By discrediting certain members of the community, they are in effect pulling the lime light off of the real problems, problems, that truth be told, is something that this person feeds on, lives for, and thrives in. Or perhaps something worse, this person may be throwing out so many red herrings to keep eyes diverted from something that they personally have done that is illegal, or is doing now.
Regardless of the reasons why this person does what they do, be that fake professors posting fake information on fictional blogs, claiming to get thousands of letters in support of the postings, though no REAL address is readily available, nor do we ever see any of the information anywhere else but there, despite the news worthy sensationalism, this is the public display a one persons personal sickness.
The only way to combat such cowardice, and such attempts to deliberately damage certain peoples names, is to require that all posters are at least to be known to the publisher, so in the cases where it rises to the level of civil damage, something can be done to correct that.

If Citizens Faux Accountability is against beer walks because of citations, CFA must really be against Harvest Homecoming's. Last year there really were numerous citations (over 100) for alcohol law violations. And that you really CAN check with the state.

None of the 100+ citations were at Bank Street because Roger hired extra security, made sure everyone was carded, and made sure drunks didn't care open containers into the streets.

The opposite was going on at Hugh E'Birs and Past Times.

Citizens for Accountability is being investigated by the federal elections commission for violation of federal election laws. Prosecutors are looking into Denhart's illegal activities. She's looking at 10-20 years in the federal pin. Call the prosecutors and ask them yourself.

This is basically the premise I was attempting to point out with my posting yesterday morning, and you can see the response I had gotten.
I questioned the tactics used by the wonderous anonymous poster who is the "mouthpeice" for CFA/FOS on this blog, and in response I got blasted, personally, professionally, and even so far as to try and guilt trip me by envoking my father.
It is a ruthless game, one of which we all lose, because a very vocal, and very aggressive minority of people in this community can not seem to let go of personal vendettas they have against a handful of people.
They subscibe to the Bush doctrine of "You are either with us, or against us".
There are no gray areas, no independents, no mid-liners in their eyes. To them all is fair game, they donot care who they hurt, they do not care who they run over, or whose lives they have the potential to destroy, the goal for them is satisfaction.

The county's position is this:

We should go to community park because it's cheapest because we already own it.

Under that logic, the government should liquidate its parks before ever doing anything else.

Under that logic, the city should use the parks, playgrounds, and sidewalks and turn them into gabage dumps, police stations, dog pounds.

it's cheapest. and who needs a park, or a playground, or a sidewalk anyhow?

our city's founding fathers were pretty stupid to make parks in the first place. i wish louisville would develop cherokee park....sure should make a nice paintball range...add a hooters and a mcdonalds.

Pezzarossi's letter is amazing. Why she does talk about facts some, she adds inflamatory details that are irrelevent to the issues Nash discussed.

Nash's objection was not anti-child. Nash's objections were the cost of the project per child, and to the location of the project.

Pezzarossi seems to interpret Nash's questions as meaning that Nash someone dislikes children.

That, plus Pezzarossi sloppy tone indicate that it was a knee-jerk letter she wrote. It's an emotional response. Her anger (at being questioned) will settled down and she might be willing to listen and discuss facts at a later point.

Anonymous made the false claim that there were 50 arrests at the beer walk. I assume he/she was trying to make the point that Roger was responsible for the arrests. First, Roger didn't organize the beer walk, so what's your point? Second, Roger didn't have any citation at Bank Street during last year's harvest homecoming while there were many other citations at other downtown bars.

If CFA would like to call the police and refute that FACT in writing, please, by all means, write a letter to the editor. Let's see who runs their businesses lawfully. Go on the record if you're so damn sure that Roger's breaking the law and everyone else is goody goody.

Roger could have kept the extra profits by not hiring security (that's "security," not "police" as you misstated). Roger could have kept the extra profits while teenagers drank beers and his place and then left to wonder around the streets. Roger could have made more money by selling to every Joe walking by and allowing them to carry an open container down to Pearl St.

BUT HE DIDN'T. Roger didn't make a fuss about it. Roger didn't call all this addition to himself. Roger didn't go around bragging that he was the most compliant with the law.

If the securing of an order of protection is true, this is nothing more than a political move by Vicki to manipulate the system to obtain a tool to have Mr. Baylor barred from attending public meetings so that she may speak as she wishes with out anyone of real note to counter what she says.
It is an underhanded trick as old as order of protections themselves. I am quite sure she signed an affidavit, and played the elderly disabled concerned citizen who feels threatened physically by the towering Mr. Baylor.
It is a shame and a travesty of justice that the courts have granted an EPO to Vicki, as she is obviously incapable of accepting the responsibility of the recklessness of her public speaking.
I know she is going to read this as well as feel certain she will respond as an anonymous poster, but I agree with the previous commenter that Vicki should be ashamed of herself for this unnecessary, unwarranted act that is designed to do nothing more than to vilify Mr. Baylor.

A good friend of mine had referred me to this website as that persons name has been raked through the mud by a person or persons who claim to be associated with an organization called "Citizens for Accountability" also referred to as "Citizens for Accountability in Local Government"

To the best of my ability, there is no record with Indiana Secretary of State regarding proper registry of "Citizens for Accountability in Local Government" as a legal, registered Political Action Committee. Nor could I find any information regarding a legal designation of the above named entity have the official title to present itself as a PAC under the Indiana Election Division, as such it brings into question if the placement of the "no" signs are illegal under Indiana Campaigning laws, if the civil / criminal penalties for those who have publicly stated that they are Board Officers of a PAC called "Citizens for Accountability in Local Government" are applicable.

If it can be proven that Vicki in any way shape or form fabricated, inflamed or manipulated the circumstances under which she obtained the EPO, then there may be grounds for a reversal of the EPO, as well as civil liability on Vicki's part.
The affidavit should be a matter of public record and available under open records laws.
In addition to this, if Vicki in anyway contacts Mr. Baylor through these forums, or if a person claiming to be a representative of Vicki's contacts Mr. Baylor, that may in fact constitute a violation of the terms of the EPO and nullify it.
To me personally, it would be worth it if I were Mr. Baylor to seek information from Blogger for subsequent posts that specifically name him, and seek civil restitution from her.
To CFA, you had a powerful potential ally in me, but now you have a powerful advocate against your group and its members with this disgraceful PR stunt. Study my initials hard Vicki, put on your thinking cap, I am sure you can put two and two together.

To my knowledge, Ms. Denhart filed the petition for a protective order, and it was dismissed. I assume that's what a previous poster meant by saying that Judge Granger wouldn't be receiving a Christmas card from CFA this year.

As for me, I knew nothing about any of it until the petition had already been dismissed. There's something very sad about all of it, especially since the purely fictitious Prof. Erika now is congratulating the congressman for heckling the president.

Some folks might judge that a shade hypocritical, but then again, Erik's a cartoon character, isn't she?

Meanwhile, the second raters wail and moan as the clock ticks into the future. No platform, no plan and no program, just rage at the intrusions of modern times. It's really too bad that we can't have a conversation that might lead to something of substance, but for so long as people where sacks over their heads, it can't happen, and that's bad for everyone.

An Open Letter to my Slanderer:

Since you choose to not allow for any direct rebuttal, I decided to post this here, publicly where it can be read.
It is a terrible shame that you would hide behind your anonymity and cast these accusations which you know not to be true, but it is even more shameful when you resort to personal attacks, and call into question my loyalty to those I consider friends, and smear the name of my father, who above all else dedicated his life to this community and in essence chose serving this community over his own best chance at survival.
We have many of the same friends and acquaintances, and those friends and acquaintances are just as loyal to me, as I am to them. I am not speaking of Roger, nor am I Speaking of VAB, both of whom, yes I would consider friends.
But people talk, and in a town the size of ours, when you step on too many toes, eventually you step on the wrong toes, and even those you feel are close to you will divulge your secrets.
Such is the case here. I will not publicly name the individual who has made the statements against me in this last personal attack when I questioned the tactics used by reputed members of CFA and followers of FOS. I, unlike you, are above that. However I will say this much; You have been betrayed, and even though most visitors to this site seem to think they know who the lions share of postings come from, I can assure you that I now I do know who you are.
My connection to the inside of your circle as well feels that enough is enough, and I will assure you of this, any further allegations made by you insinuating illegal campaign contributions, or any unfounded character attacks on me, my family, my business will be met with a lovely civil law suit for defamation of character. You can leave your lawyer friends at home as well, I will take it through small claims where it is just you and I, a couple of character witnesses and the proof I need to take action.
In addition to this, I am quite sure I can manage to make it front page news, as a person who was in your position creates quite the sensationalism.

David Huckleberry was jeered and catcalled whenever he spoke at a Council meeting, because the Progressives didn't like the way he spoke. The intimidation didn't stop there. Someone started leaving piles of newspapers at the end of his driveway EVERY NIGHT until Dave put a sign up Trespassers will be SHOT ON SIGHT.
Once Baylor was removed from this last meeting, his professional wife would lean over and act like she was fiddling with her socks and doing the cat calling.

His whiskers were touching his face and I hear he smelled bad.

Come on Council, you can not let a few intimidate, harrass and interrupt these meetings. I don't give a darn if he lost his temper or not. There are several good citizens who do care about other things than the Progressives' ideas.

Spring Street looks beautiful!
The bike lanes are beautiful!
The only way to improve on it is two-way traffic, which won't take long.

The Tribune article said the only cost of the bike lanes was the two extra paint stripes.

As long as the two way ends by Bank Street, then no traffic lights will need to be reprogrammed. All the city will need to do it take some stop signs and turn them around 180 degrees.

Price said this was going to cost $2 million. Was each stripe a million each?

Fewer cars? Some people think cars are traveling other streets and some think many people have moved out of New Albany. (How many vacant houses are there now? Slipping to a third class city?)

If CFA wants to do an honest, scientific traffic study, I'm fine with that. But we also have to do an honest, scientific study on improved home prices brought by bike lanes, pollution levels, noice levels, safety to neighborhood children, etc.

If you want accountability, I say bring it on. I want accountability in city planning and traffic patterns too. It appears that the city is finally moving in the right direction. Now we just need some two way streets. I'm willing to hold that opinion up to scrutiny, but everything gets to be scrutinized.

But we can't forget about what we can't see, namely the sewers and storm drains. We can't forget about all of those people who had a foot of human waste in their basements or yards so polluted their children could not go out to play.

I agree, in principle to what you are saying.
However, I must add this to that topic of conversation;
When my block on my street sat unassisted for months on end with rental homes flooded with raw sewage, sweltering in the summer heat, we could not and would not get assistance from the city.
When a letter to the editor was written questioning the motives and lack there of from our districts representative, when myself and others had called him, and written him letters, with no response, AFTER it hit the papers, regarding his failure to act on the behalf of those he represents, I got a lovely phone call from him, cursing me, swearing at me, and giving me the good old " If your dad was around, he would be so disappointed in you"

This former council member is now involved in the very small, but very vocal group who demands accountability from Government, and supports the measures being pushed by that particular group.

I ask this, if we KNOW individuals who refused to act on their duties to protect the safety, welfare, and well being of the citizens that they were elected to represent are part of a political action group who is unfairly obtaining favoritism from persons with in city government, how can we truly expect to foster and real change?
Any attempts to better situations that truly matter to the health, safety and well being of this community are met with fierce disapproval, misinformation, and public criticism based on unfounded information, therefore nullifying any attempts to effect change.
Another prime example of this was enhanced code enforcement. Committees were formed, meetings were held, and nothing happened, the committee was dissolved, the city is in just as bad of shape as it has ever been, and Lo and Behold, many of the more vocal people against that action are now the ones displaying the lovely "NO" signs in their yards.

Supporting, harboring, or even turning a blind eye and NOT speaking out against the biased, unfounded actions of this particular group is nearly as bad as the actions of the group itself.

It is high time that the silent MAJORITY, who support progress, which supports fostering of initiatives that cater to the health, safety and well being of this city, measures that improve the infrastructure, and prepare the way for our city to at LEAST catch up with Jeffersonville, Clarksville, and suburbs of Louisville.
We are lagging so far behind on everything because of factions that do everything possible to stall any efforts for this city to pick itself up by its boot straps.
But the days of an outspoken minority of political has beens dictating the policies of this city through a campaign of misinformation, deception, and "untraceable" character assassination is coming to an end.
This is not our city, we are merely have it on loan from future generations, and it is time that we choose, are we going to leave the next generation a dysfunctional, ill maintained, antiquated mess we are living with now, or are we going to turn it around, not only in spite of, but as a direct challenge to the small group of individuals, to show them what this city can and should be!

I agree that the sewers are a serious problem that need serious attention. But it's not "either-or." Painting two stripes down each street doesn't mean we can't fix the sewers. Converting streets to two ways doesn't mean we can't fix the sewers. We can deal with the sewers AND redevelop downtown. The city just has to try. Right now, councilmembers are saying they're not willing to try.

Of course you have a point. A really good one. These sewer and storm water problems need to be fixed.

The problem with the likes of CFA is that, all they want to do is whine about the sewers but don't want to pay the fees and taxes necessary to fix them. Seen the "NO" signs?

I can just "hear" them, right now. "We have already spent a gazillion dollars and the sewers should already be fixed!!" That could very well be true. However, unless CFA can prove that fraud has occured in the repairs of the sewers and force money to be paid back or extra work to be done for "free", the sewers are still backing up in people's homes.

Has anyone heard a plan from the naysayers to fix the problem? Again, all they want is to take advantage of the situation. If they really cared, they would be willing to pony up the money, to really help those owners and all of New Albany. Woulda, coulda, shoulda, has not fixed a problem yet.

No, and I drive it every day at or near rush hour. No impact whatsoever other than a little bit safer traffic speeds. I will, however, enjoy the bike lanes.

I did not mean that we should not paint lines and make bike lanes in the streets. I just meant that we should not forget the sewer problems. I agree that we can't fix the sewers for nothing. The money spent in the past is gone and we can't get it back. We have to look forward and try to make our city safe and clean.

Can't they put some bike lanes on Main St. also? I wouldn't bother with Market traffic tends to be slower on that street. In fact I passed up Roger in a Geo Metro today on my bicycle carrying a vinyl copy of Goat Head Soup in one hand, and Cold Roses in my mouth.

Is there suppose to be a sing along now? Dancing with Mr. D maybe?

It was a strange biking day today. Three different fifty-something shirtless males riding bikes downtown. Hair, bandages, guts and wheezing. It was distracting.

I've never really understood why we need to be seeing things like that.

I may be ugly, but I always wear a shirt. Then again, I'm only 49.

It's true "Some Girls" is a better album. Um, Cold Roses is a Ryan Adams album not to be confused with Bryan Adams when you were in high school. I don't know of any half naked 50 something year old's who listen to Ryan Adams.

You should program your computer so you can strike one key for a commonly used phrase.

The A key could be; Down with anonymity!

The T key could be used for when you write your guest column in the Tribune; I was in the country of ______ about _______ years ago for the _______ festival drinking _______ beer with my ______ friends.

This way you can save time while regurgitate the same old story again and again.

It would be nice to see creativeness from you Roger when you write, and not just use words that are uncommonly used, you are only impressing yourself which you're great at doing.

There are those who also enjoy Rogers eclectic writing style.
Comparisions with his lifes experiences, both home and abroad give the readers who actually ponder what they read, an insight to what makes him what he is, and has shaped his view points.
With out taking the time to consider the totality of what he is writing would be similar to viewing photographs of a rainbow in only black and white prints.
You know what it is supposed to be, you know there should be colors, but everything is lost in shades of gray.
Keep writing the way you are writing Roger, we may not always agree all the time, on everything, but the stories of your adventures are both home and abroad are informative and entertaining, especially for those who take the entire concept into consideration, not just the words that are typed.

The majority of thoughtful, honest people would agree that yes, conversations like ours are fruitless. One of us bears the burden of integrity, and the other mocks those who are willing to put their names on the line even when they're wrong or tactless, as I've certainly been in the past.

That's something you and other simply don't get. So be it. I'd have signed the Declaration. You'd have used a "Mad as Hell Colonial teabagger" tag. So be it. Posterity will judge, won't it? Especially when I'll be writing that historical record.

I have travelled, and rather extensively. I just chose to keep it on this side of the pond.
Thanks for the tips though, riding a rail car with hobos is definately an easier option that hiking the AT, or the boulevard, and thanks for your opinion.
