RAIN, RAIN, GO AWAY!!!

I am sure this is what many attendees of last night's council meeting are saying now. Many residents told their stories of having flooded basements, even sewage in their homes and pleaded with the council for help. Many council members were obviously disturbed by these stories and accompanying pictures.

It is a terrible shame that people have to live like this, losing countless thousands of dollars and living in unsafe homes that are unsellable. Thankfully the resolution passed 9-0 that would free up funds to reimburse these people. Also Attny Shane Gibson promised to look into these claims and forward them to the city's insurance company. The residents also filed Tort Claims to help reclaim some of the lost funds.

The other major item on the agenda was the Ordinance to allocate $1,000,000 to hire 10 new police officers. After the first vote failed to pass, CM Messer asked that the Ordinance be amended to be reduced to $500,000 and hire 5 new police officers. CM Caesar changed his vote to aye and the Ordinance passed 5-4. Voting aye were CM's Caesar, Benedetti, Messer, Zurschmeide and Coffey.

By the way, there were several eloquent speakers last night at the podium, especially Vicki Denhart. She used to have a fear of public speaking but obviously overcame it. Good job Vicki.

What the hell does Councilman Coffey know about accountability? He is a disgrace to his district. Him and the others sold those poor citizens out. In my opinion he needs to be removed from office.

Denhart, who continually lambastes the concept of a "bailout" at her anono-blog, merely pandered to last evening's crowd and, in effect, said that we should take any money we have and "let them have it."

Coffey let it be known that the way to avoid all future problems is to have him (oops, I mean the council) rule on it. Great. See any engineers up there? I don't.

But they're right, even if for the wrong reasons. The solution to the construction/drainage/sprawl/planning problem is a massive, intelligent, comprehensive green plan that is designed for the future, properly funded and built for accountability.

Might take ten years to make a dent in fifty years of debacles, and cost more than a few million, but that's the only non-Band-Aid out there. And none of you are willing to pay for it, are you?

When you find any elected or appointed city official with the credentials and the chutzpah to go there, let us all know. Otherwise we get more of last night's pandering, sloganeering and vote-browsing, because that's all it was, folks: A farce of crocodile tears from people who know they lack the ability to do anything about the real problem.

It is, Christopher, but like Roger said, you can't make up for 50 years of neglect overnight. That doesn't mean that we don't give a major effort. However, $35-40 a year per household isn't going to pay for very much. It could, possibly, over time but we need a quicker fix than that amount of money will allow. IMO, of course.

I know its been mentioned previously, but we are now paying the price for unchecked destruction of green space.
Water run off impoundments in recent developments do an okay job for the immediate area, but even at that a run off pool is not nearly as efficient as a good old fashioned patch of trees or open field.

I suspect once the Coes lane develpment chews up that large open grassland on the left before the series of turns, we will see massive drainage issues occur there as well.
The Castlewood area is common sense, you have the concrete jungle on the east side of Grantline road, and since castlewood sits much lower, well, break out the life vests and rubber dingys folks.
One of these days we will wake up and realize that nature has a plan, and it works, after all it took billions of years to perfect the system.

How would you like to wait until fall to have your drainage or sewer fixed?

Any respect I had for Caesar went down the drain with the rest of Messer's, Crabtree and Haub's crap.

I hope every one of them have to experience what those family's have experienced and been through

But I don't think they all live in New Albany, do they?

Sure glad that was not our home being discussed.

I think it's criminal England doesn't use the new CDBG money $195,513 on the drainage these poor families need fixing instead of E.Spring St. & SEJ.

Got to ask:
Are people still being told (by city officials) that they need to IMMEDIATELY call the wastewater treatment plant, when they are having/seeing any sewer backups? Then to also call their Mayor/Council Members? Are the employees of EMC at the plant 24/7? Do they operate the plant on "automatic" at any time? Wonder how many residents there were, who had problems and didn't notify anyone! Is any information on what residents are to do in case of sewer problems, included in the sewer bills being sent out? (Yes, I know it should be understood that they need to hire any attorney, if they have damages).

The signs that are not placed on private property with the express consent of the property owners is nothing more than litter and vandalism.
The signs placed on public right of ways, closed properties with out the express consent of the property owners, and nailed to telephone poles are illegal, and CFA should be fined for each and every incident, and I think people should make the calls to the code enforcement officer starting today, you see a sign posted illegally, call it in, we will see how quickly CFA becomes a non-entity again.
(for the record I feel the same about "we buy houses", "prescription medicine help", etc....
Equal protection and enforcement under the law, I am sure CFA will appreciate and understand that.

Be accountable, and be what you say CFA is, remove the illegally posted signs!

I agree with you about all of these signs for mortgage companies, house for rent, yard sale, cheap medications, etc. They are everywhere.

At least the CFA signs are neatly printed by a printing company. Is the sign on the corner of Grantline and Daisy illegal? Everybody in town had signs there in 2007 during the election time. I had one there too because everybody else did and I thought it was OK.

Finally it's good to see an organization fighting for the little guy.
They must of raised the funds to make their signs or collected donations.
I'm with you Shirley, I think their signs are neatly printed. You can even read them in the dark.
If they are a PAC, and I am willing to bet they are, they are required by law to place a disclaimer on signs. The property belongs to Mr.McCartin and he allows democrats always to use his corner, even Douglas B. England did in the last election. So if it's good enough for England's campaign sign, it should be good enough for Citizens for Accountability. Get off your soapbox, it makes you naysayers look awful bad.
btw, on NAC they are mocking their sign, but I suggest unless your registered with the State of Indiana, that sign in there can come back and bite you if you are not careful.
Indiana Secretary of State Todd Rokita take signs very seriously and if I am correct, Ms. Denhart is very good friends with him and others up state and in Washington.

Yes, let's discuss FACTS.

Let's talk about PROOF.

You can make a lot of accusations, but show us the proof. Show us some EVIDENCE.

You're great a rumor spreader. Show us you actually know something real.

Now a tiny number of the points you make are true, like the redistricting plaintiff's attorney getting $5000. That's because the judge ruled that the city didn't follow the constitution. Beardsley never would have received a penny on the case if Coffey or Price had voted to redistrict.

Now what's more important? You want to point your shameful finger at someone who gets paid to work to see that the city follows the constitution? Or would you rather point your finger at Price and Coffey and the others who have repeatedly failed to obey the constitution? Go get your attorneys fees refund from Dan Coffey. Also get a refund from Price and Coffey for the sewer contract lawsuit. That's just the start.

If you're not for the constitution, then you're not for Freedom of Speech. You also must not be for other constitutional rules, like rules keeping the police from locking you up "just because." Well, maybe we'll stop trying to have a little rule of law in this town. Maybe someone will pull you out of bed tonight, carry you off, lock you up, and throw away the key without a trial. It would save the city money, no? If you're in jail, no one had to pave the roads you drive on.

Any decent person should feel insulted by that post. It is shameful of the poster, but it also is shameful of the blog admin. Yes, you can go in and delete the post, but the damage has been done. The post has been made and it has been read. And you allowed it to happen.

If you have evidence of a hacking, go the police. Since you have not gone to the police, I assume you have not evidence of a hacking, or of much anything else.

Yvonne Kersey was in a mental state that allowed her to invite the police in and show them to the basement. If she were in that mental state then, why should we believe she could reason who hacked into her computer, or that anyone hacked into her computer?

1. Here two wrongs makes two wrongs. If someone murders your child, you don’t suddenly have the right to murder their child. Your remedy is in the courts.

If NAC defamed you, you also have a right to sue Roger, just has Randy has the right to sue you. It don’t suddenly have the right to defame others. Again, someone ask you a tough question, and instead of answering it, you point the finger and make up an new rumor.

2. The law makes a distinction between stating something as an opinion and stating something has a fact. The 6:09 defamatory statements were stated as if the writer knew them to be facts. It doesn’t matter if you think they’re opinions. It matters how to state them and you did not state them as opinions.

3. Defamation law makes a distinction between statements about public figures and statements about private citizens. Political speech has higher protection than speech about private citizens. Don’t believe me then look it up. Also, private citizens who seek to input themselves in public issues (such as right letters to the editor about government policy) can move from the “private” to “public” level of scrutiny, if your speech related to their public actions. That is, if you choose to become public, you get the lower level of protection from defamation because we know can talk politics about you instead of just your private life. If you just write about a private individual’s relationship with his wife, and you’re wrong, then you have a loosing lawsuit on your hands.

Start saving up for a defense fund. I don’t think anyone’s going to take your case for free.

Castlewood area was suppose to be turned into a drainage area but someone downtown changed the landscape and let someone build. The new stormwater laws are going to bite on the new tow in lot and it's drainage. We tried to tell them the new laws call for something to contains radiator fluid, oil, other contaminants which may occur and they simply go ahead and do whatever they wish.


Do we have a new Stormwater Master Plan; we started back under Bob Real with the studies.

I personally would like to know of any drainage projects finished and who or what they helped.

I understand that we do have a stormwater master plan but I am not sure who to ask. I guess the best person to ask would be Brad Kessans, Utilities Director @ 948-5320. Hope this helps.

If you are still reading this blog, do you now see why NAC has the "rule". Is there any doubt that 6:09 would not have posted their "rant" if even one person knew who they were? I know that you have to find that comment's contents disgraceful. Like I said before, it's a trade off. Shirley makes a good a point, but at least 99% of the people picking on Mr. Price take public responsibility for their words and actions. That makes a big difference.

Yes I agree that any personal attack on a neighbor’s character is sad and regrettable. In my opinion all such actions, be it satire, patronizing remarks, or direct abuse, is one reason blogs are not good places to take on complex issues.

Malcontent is not the product of anonymity but the desires of people who lack the ability to self evaluate and desire to improve themselves every day.

I have seen the same personal attacks on "other" blogs
One concerning rental property where one neighbor was complaining about a fellow blogger who owned the property. The comments where later deleted.
Not having anonymity did not stop this personal attack but if both had had anonymity it would never have happened because they would not have known each other. Only issues would have been able to be talked about.

The problem of baseless personal attacks would be better resolved if there are enforced rules against such actions and a standard set by the administrator adhering to a high level of conduct.

I am not trying to sound overly righteous. I am not nor have I been blameless. I gave my reasons for anonymity and they had nothing to do with hiding or trying to attack anyone. I understand your point we just see things differently.
I have not forgotten about previous topics and the promise to discuss a plan for New Albany. I have been busy. Thanks for the email invite

RemChar, quit taking complicated historical examples, over simplifying them, and then slanting them so that all history magically proves your particular point. I could take the same historical characters, selective pick my old facts, and come up with the exact opposite conclusions. Being able to recite a few historical characters’ name and making a few loose analogies does not mean you understand them in context and does not mean your “points” are valid.

Sorry you guys don't like historic analogies I only use them as supports of opinion. Are they perfect examples? No but they are close enough. Are they out of context? No, they are parallels and they make valid comparisons.

Am I saying that I am as smart as the historic characters I reference? No not at all. Do I read and look to history or current events so not to repeat the same mistakes, yes I do.

If my analogies are wrong please correct me. If they make me sound stupid then that’s fine with me I understand them.

All the analogy was getting at is that slander has been a part of free speech from the beginning.

It was not a direct comparison of this blog’s current dilemma.

I am far from the smartest guy and I never think that I am if I did I wouldn't need analogies or references. People of all different temperaments talents and convictions hold some truth to what they say or belief in and I love listing to all peoples’ point of view.

Getting back on subject here:

Literally, it would just be a drop in the bucket, but if homes in the higher elevated areas would use rain barrels on their down spouts, it could actually stop a large amount of run off.
I have 110 gallons worth of rain barrels (recycled 55 gallon plastic drums, which can be painted or hidden behind decorative grasses or shrubs)
Each time it rains I get 110 gallons of free, clean clear water for watering my lawn, topping off my water garden, filling bird baths, and small washing jobs around the yard.
Like I said, 110 gallons really isnt alot of water when looking at the big picture, but multiply that times 100's of homes, and it could make a difference, if not in flooding, definately in water conservation and decreased sewage bills. (since sewage bills are based on water usage from the meter).
Give it a thought people, you can get clean pastic 55 gallon drums on the cheap, and for a $10 at ace hardware you can get the stuff to hook it up to your downspouts.
Secondly, it is important that WE, the citizens, make sure that the storm grates near are home are clear of obstructions, and dont sweep your yard clippings, leaves, and such into them!

As a side note, yesterday I refilled my garden pond and bird baths with water from the rain barrels, today as I watch it storming out side it was a good while before water started coming out of the over flow on it.

But, the hose on the main barrel runs over to my bird garden, which has a good layer of gravel under the mulch (to try and keep uneaten seeds from growing).
My neighbors yard is covered in standing water, as is the alley behind my house, but my yard is fine a few puddles here and there and thats about it.

another little water conservation secret I have is in my front yard is a couple sections of pvc pipe sank into the ground with a screen in the bottom, thos pipes lead under my gardens into areas that had been filled with pea gravel before recovered with dirt and planted. to get water deep into the soil.
THese also work well for practicing chip shots with golf balls!

Little steps repeated over many households can make a HUGE difference, and this is how we have to start to think around here, not be reactionary to the governments follies, but proactive for OUR community in situations like this

Inside the monthly books remitted to the EPA (located in the basement in the Library, downstairs in the reference area) are places listed requiring signs up listing sewer overflows; required by the EPA. You can see them at the ballpark by the expressway and another obvious one is in front of the McDonalds on Charlestown Rd.

There are 3 such overflows listed at the old New Albany Country Club. The Potty Police went up to the Country Club by crossing the creek across from Marvin's Auto Shop on E 8th. After checking the creek out, we proceeded to climb the opposite creek bank and see if the signs were up on the Country Club as where we went in at there should have been one. We proceeded to climb the opposite bank and popped up at the edge of the NAC. There were a group of golfers and we startled them, as they did us.

We went back shortly thereafter and were surprised they erected a metal fence and cut trees down blocking the creek and access, forever.

Has that creek been cleared of the blockage NAC created deliberately? All we could think of was the horrible flooding down by the Salvation Army and now wonder how hard of a hit those businesses were hit THIS time.

The rest: Without them removing Sanitation, Drainage and now the Stormwater monies are lumped in with the Sewer Funds, the DOJ can put us in a heap of trouble finding out the sewer money has been spent on a lot of other things, like shoring up the General Fund, etc. We do not see how they do the rate increase feasibility study with the finances in the shape they are in.

Hope we helped. BTW, there is nothing that will be able to be done because this was a major event and they do not get in trouble as this was an unusual rain event. Mr. Baylor, did you know your father attended sewer board meetings for six months to a year because HE didn't trust them? Run a check on Sewer Board minutes.

There was a stormwater master plan under Bob Real, which went to England in '82 calling for a major retention basis at the top of the Knobs (Mosier) to help save Linda Drive. Never happened.

Every four years we come up with a new "Stormwater Master Plan" but as of yet, no work done. Glad to see the Stormwater Committee wants to have the Planning Department make sure there are drainage requirements in the Developer's plans, but good luck on that one.

Remember Castlewood was suppose to be a drainage retention area and that got circumvented, also.

The New Albany Potty Police will tell you the City will not get in trouble over this last rain event because it was an "unusual" occurrence, to say the least.

Shirley, you can start by asking Rob Sartell down at the Plant where the stormwater master plan is seeing the City took Drainage away from EMC.

Doggone it, left out a major piece of the puzzle. In the monthly booklet submitted to the EPA, Eagle, our subcontractor who goes out during heavy rains states they can never get into WATCO STORAGE. Lucky for us a friend of ours is a cousin to former Sheriff Leland Watkins. He allowed us in and told us he had given Eagle 3 different codes for them to get in and out; they just do not go there. We checked things out and got our pictures and documentation (thank you Mr. Watkins). This would be the same line running down to the former NAC. It's ALL relevant.

It would have had to be a few years back, for sure. He didn't trust their methods of handing out sewer credits, something to do with land he owned at the time.

I'm not going to do your work, run a search on the Sewer Board minutes. One of the Potty Police members was there with him. No offense I hope to anyone. "Be careful"! Just for info:
Many miles of sewer lines are outside the city limits of New Albany. They are owned and controlled by the city utility. Sewer lines run out towards County Line Rd., out Green Valley Rd and up the Knob, and out and up to Highlander Point. Georgetown lines may be owned by Georgetown, but there were discussions about ownership of some of them by developers. Developers & land speculators - don't you just love them?
