FIRST COUNCIL MEETING OF 2010

The meeting began with a quick race for Council President, Mr. Price nominated Pat McLaughlin and Mrs. Benedetti nominated John Gonder. Mr. Gonder won 5-4 with Benedetti, Messer, Zurschmeide, Coffey, and himself voting for him. Mr. McLaughlin got the silver medal as VP.

After the committee members were appointed and/or voted in, the next order of business were the public communications. The parking permits were the main topic tonight. Jameson Bledsoe, Randy Bulleitt, and Vickie Nugent, all Uptown Neighborhood residents spoke in favor. They all discussed their own parking problems and said they would pay to have a designated spot in front of their homes. Randy Smith said he lives on the narrow part of Elm St. He questioned the the idea of having 20' per space considering some lots are only 35' wide. The council voted and decided to sent this Ordinance to committee.

There were a few issues discussed during the city official communications. Mr. Gahan said that A 09-21 (the $400,000 for the flood victims) would be back on the agenda for a 3rd reading at the next meeting.

Mr. Malysz, speaking for the Mayor, urged that A 09-22 also be added to the next agenda (this was the $2,000,000 from EDIT for the fire and police).

said this will be reviewed by the Rules Committee and the Mrs. Benedetti asked for a prompt decision on hiring a new attorney for the council. Mr. Gonderrecommendations will be considered by the council. Mr. Coffey stressed that a Floyd Co. resident will be preferable.

There was also much discussion on Resolution 10-01 concerning the Coyle property. The city has already spent approx. $50,000 for appraisals and an enviromental study and enlarging the TIF area will help to recoup these funds. This also has been sent to committee.

This is a very short summary but the meeting ended by 9:00 with no fireworks. But the year is still very young. Stay tuned.

It was a noteworthy meeting because Steve Price openly supported increased fees in the form of the parking permit.

Nice precedent to begin the year, but just imagine how much more money we'd raise by registering and regulated rental properties.

Just a thought. What if we expanded the TIF area and let the Coyle family sell the property to a developer. Then the property value would increase and so would our tax base.

Just because money doesn't go into TIF, it doesn't mean it goes into our general fund. TIF's are the only way we have to ensure that the money stays local.

I know of developers who are salivating to refurbish the historic building. It is a fine building. Not a bad idea. But eventually we will need a new city county building and pretty much already do need one so we would need to find another building or location.

People in Louisville drool over buildings like that so close to both downtowns. Some developer would want it for sure. It is actually kind of exciting to think about for New Albany.

I don't know where to being with the differences, biases, and contradictions I have read between NAC and Shirley's blog.
First a correction.
Shirley, I do not want a residential parking place in front of my house. The only things that I said was, I supported Randy's efforts, that I thought it would be good for the street department, and asked the council to consider it. I know that it is hard to hear sometimes in the room so no problem with the mistake.
Contradictions
Randy Smith said he had a problem with the idea of residential parking permits because parking on his section of Elm Street made it difficult for the two-way traffic but Randy will be one of the first people to say two-way traffic with curb parking, mediums, and bike lanes are great for Spring St.
You can’t have it both ways Randy Smith, your comments last night are complete contradictions to your arguments for two-way traffic on Spring St.
Roger, Jeff, Mark, and Randy all ridicule the council for being slow to make decisions but when someone else has an idea and the council vote positively and quickly they are the first to condemn the idea. This is just another contradiction in a long list of contradiction found on the bias NAC. Instead of supporting a new idea you condemn it before you know anything about it and then pretend to justify your actions by assuming what the ordinance would be.
Here is a suggestion that would serve you all well, try and ask questions first then form an opinion about it. This would prevent you from being incorrect.
There are many more contradictions to make but I will move on to biasness of NAC coverage of the council meeting. Let me remind you first that the Progressive group no longer has the ability to provide readers with half-truths. Other people like me are beginning to go regularly to the meetings.
You would serve your readers better if you would just state the facts about the Coyle property. Mr. Coffey from the beginning has always said he did not support the purchase when he found out that it could not be paid for with TIF money and that both he and Kevin quit going to the committee meetings after the first one. Which Kevin acknowledged. Who set up the committee is irrelevant to the discussion and Carl needs to quit saying that he is only acting on the councils request when clearly the council is against it. He needs to be truthful and say the Mayor’s administration wants it. The Tribune needs to call out the contradiction in his statement by asking why then has the council voted down the expansion of the TIF district.

Excuse me Bluegill, but do you know HOW MANY TIF AREAS New Albany already has that are depleting the General Fund?

How much money did the TIF on the Parking Garage pay to the General Fund? Monies which should have been paid back to the General Fund. I forgot, you are the one who got technical with the wording in the document saying Redevelopment didn't HAVE to pay the monies back to the General Fund, sorry I forgot.

I certainly am glad others are starting to attend Council meetings and can attest to the hypocrisy on NAC. Whew, I can breathe better.

I find it odd that when I made the suggestion to use the 1 million dollars of EDIT, that the police where requesting, to purchase problem houses Randy commented on NAC that I’m being naïve. Jeff didn’t make a comment to disagree with Randy so I assume he agreed with it but recently Jeff and Randy have both talked about how great the 6.7 million is going to be for SEJ and Jeff goes as far and says look what we could do if we used EDIT money along with the 6.7. If we had done it the Progressives’ way we would have spent all the EDIT money on paving and two-way traffic at the beginning of last year. There would be no EDIT money left.
Mark, Roger and others talk about how the council made appointments last council election and then applaud President Gonder’s way; he did practically the same as Coffey. He removed Kevin form the Redevelop Commission and replaced him with someone hardly any of the councilman/woman knew. How legal was this Mark? Where is the condemnation? I see this as another contradiction with the Progressives. I know Matt, he seems to be a good person but I told Gonder I didn’t think that appointing Matt was the best for New Albany citizens and I will be publicly stating that at the next council meeting.

Get it right Roger, the council voted down the expansion of the TIF because they don’t want to buy the Coyle Property the only reason it was on the agenda is because the Mayor’s administration spent 45,000 dollars on appraisals and environmental test and they want to use TIF to pay for it and continue the process to buy the property over council approval.

The residential parking permits are only voluntarily acquired it is very different then rental property registration which would be mandatory. Even though rental property registration is a good thing it is completely different. Comparing them is a disserves to readers and the only reason I see the use of the comparison is jealousy that someone else’s idea is seen in favor over your own. When the exploratory committee determines what the ordinance with comprise of then you all should make your comments.
How I understand what Mr. Bulleit’s proposal was what Jeff uses and each request would be a case by case bases. The Street Department could deny the request if they determined that there is no need for a permit. I would only be issued if there was a need like what Mr. Bulleit has and I think that the council sees that such a ordinance would be good for their district because 7 of them voted strongly for it and the other 2 said they liked the idea but wanted more information which is the same mistake Randy Smith made.
Market forces has nothing to do with the parking permits but it could make New Albany more marketable when someone comes into the city to buy a house and they can clearly see that parking may be an issue. They now have the option to buy a single space in front of their home if the Street Department agrees to do it.
Steve Price did not vote new arbitrary fees the permit is a voluntary only program. I understand how someone reading the Evil Socrates NAC blog would think that.

TIF Areas.

All new taxes collected in a TIF Area
go into a TIF FUND POT that Redevelopment can play with. Those tax collections do NOT go in the General Fund to help run the city or to help keep our taxes down.

Did anyone ever try to explain to the Council Members that the Mayor and Malysz control the Redevelopment Commissionm?

See Indiana Code Chapter 37, I think.

Redevelopment is a 5 member voting Board.

The Mayor appoints 3 m embers.

City Council appoints 2 m embers.

Do your math.

3 out of 5 m embers can control
Redevelopment Commission.

So-- the Mayor controls.

then when i don't renew next year, the sign sits around because no one cares. free space for me year and year. all i got to pay is $100.

how much does the sign cost the city?

For what its worth, heres my take on the parking permits:

1. Those with the $$$ to cough up $100 per car for "private" parking can purchase exclusive rights to PUBLIC property. In any other situation this would be considered immoral if not legalized bribery.

2. House #1 has very little frontage on an urban street, while house #2 is on a corner and has front and side street parking.
House #1 has 2 cars, no alley parking as it is almost everywhere, no driveway or garage, as it is for many inner city houses, each of house #1 neighbors buys up spaces, yet #1 cant afford it, so their car ends up down the block or on a cross street close to their home. It wont be long before some else where their second car is parked to get pissed and vandalize it. (that all ready happens here with out buying a parking place from the city.
3. House #1 purchases a parking space, house number 2's guest constantly park in it. A dispute ensues, police are dispacthed, (generally 2 officers for a disturbance) in the time it takes for the police to straighten out the issue, the $100 "profit" is chewed up in man hours for the 2 officers, the dispatcher who runs the warrant checks for the involved parties, then we move on to the gas in the patrol cars, etc... Pretty soon that $15k potential profit starts getting whittled away, of course that is before taking into conideration signs, sign posts, paint, man hours to install those items, design, printing and dispersment of permit stickers, not to mention paying someone to process the applications.

We should concentrate on more important issues.

Chris, I understand your points.

In Jeff those who cannot afford to purchase a permit can still request one and the Street Department will issue one if they determine that one is necessary. Even if someone has the funds and applies the Street Department still has the final say.
Your analogy about the two houses, again, if you can’t afford one, under Jeff’s rules, one could still be issued and only one permit per house hold, so a house could not buy more than one.
My support of Mr. Bulliet’s ordinance was given with the understanding that the New Albany Ordinance would be like Jeff’s. This ordinance will go to committee where they will come up with one that is tailored for New Albany. If it changes to an ordinance that is contrary to Jeff’s, and I thought it would be a bad idea, I would withdraw my support.
The concern with tying up the police department is a legitimate concern. Mr. Bulleit presented the council with communications from Jeff’s police chief endorsing the idea and stating that he thinks it would work well for New Albany. Jeff has had no problems with their ordinance and I believe if home owners who do have a problem could possibly resolve it through Mr. Bulleit’s ordinance. It could possibly free up the police from disputes. One of the council members gave an example of his neighbors having this very problem on his street and that the ordinance might have prevented the problem.
This was not my idea and at first I was reluctant to consider it but I could see that Mr. Bulleit had a legitimate concern and if he had one I felt that other citizen might have the same problem. Mr. Price talked about his elderly mother who my benefit from such an ordinance.
I find it amusing that some who ask for more governance now opposes such ideas. If this ordinance becomes a problem with the police department then it can be easily overturned.
Are there more important issues? Yes. Is this something that prevents attention from those important issues? No. The Mayor repeatedly has said that the Street department needs money to take care of signs and street painting. This could be an idea that gives the Street Department a little more money to do just that.
This is a voluntary option not a tax or mandatory fee. We have handicap parking spaces this would be similar but not the same. If the council accepts Mr. Bulleit’s idea I don’t think the city would stop.

If the city buys the Coyle property the city would not gain but lose tax revenue from the purchase because city property is not taxable. The only positive is that the city would have a unique old city/county building.

The TIF only matters if a private party invests into the property and the city needs the State Street TIF to increase in value.

The street dept can't get their current workload done. Now they have to hang signs and paint spaces.

I'm sure there will be tons of money left over after buying sign, paint, labor for installation. Shouldn't that windfall go to police for their time to enforce.

What about street cleaning? In my neighborhood every body moves to one side of street. So two days a week it may get tricky (April-oct)

You do make good points in your presentation, and I understand it is not your idea originally.

Personally, I still remember dozens of dispatches on "reserved parking" issues, specifically handicapped reserved spaces on the street.

However, I respectfully suggest that we agree to disagree and leave it at that.

I mean look how much time has passed since a sidewalk in town had been "fixed" and the bitterness and accussations are still flying at every opportunity.

This can only serve to further divide the community between those who feel the "haves" are further raping the "have nots"

As for as the appointment/election "affair", at least there was a public vote and the opportunity for a majority of the council to deny or confirm according to the law. That's a big difference from past years.

If, when you were writing about the parking permits, you were referring to Pat's discussion of parking disputes in his district, Pat is afraid that this might stir it up again--not solve it. So much for accurate reporting, I guess.

I don't have sidewalks in my neighborhood. Can I get some for $100? Wait, I knew that there were not sidewalks when I bought my house--it's called personal responsibility and that's something that I would think that we would agree on.

Two houses, all else being equal, one has a driveway for off street parking and the other doesn't. Which one is worth more? How much more? I would think much more than $100/year.

Did you hear all the questions about the ordinance Monday night? The councilperson introducing it didn't even know who would enforce it. Was surprised to learn that the police would still have to be called. It was far, far from a finely tuned ordinance and only AFTER all the questions was it determined that it needed to go to committee. That's the way it should work and did work.

As you also failed to report, Randy Smith said that perhaps an ordinance could be presented that would address his concerns. I feel the same way. I'm not going to a blow a gasket over this ordinance, no matter which way the final vote goes.

There would seem to be a useful precedent for having reserved handicapped spots. Seems to me there might be a plausible way to extend a program to include seniors and certain other classes of need. I see no reason why that should be extended to the able bodied, especially on a street that all of us own as taxpaying residents.

And: I'm genuinely happy that Jameson is getting the NAC phobia off his chest, as himself. It bodes well for the dialogue.

I wonder if the "big lawsuit" is the lady who tripped on her way to harvet homecoming on mainstreet? (friend of mine), If so, keep in mind it was at a transition from conrete to brick, where there was an Indiana-American water meter that had "raised up" as compared to the rest of the area, while walking in the evening and it was getting dark.

If it is the same "big lawsuit" the only reason the lady is suing at all is because she has no health insurance, and severely damaged her shoulder.

Where this ties into the continued bitterness to a 20 foot stretch of on bank street is beyond my grasp. (and its not like your target is the only owner of the business, let alone the owner of the building, correct?)

I have never read anything that Tribune reporters have ever printed that wasn't true. I only question the inconsistencies that I read from what I know, first hand. Most of the questions and inconsistencies that I have are between what the council says and what the administration says.

I would like to see the Tribune run a story educating New Albany citizens about TIFs. I have been given two explanations, both from reliable sources. The two explanations given are very different reasons why we need TIFs. I have to call the LDGF and find out which is accurate.

Mark, Yes, Pat did say that the permit could cause his issue to flame up again after he said it could have prevented the problem. I think he was looking at both sides of the equation, which is a good thing for a councilperson to do. He must have thought it was worth voting for.

The process of the ordinance was Mr. Bulleit’s responsibility, it was his doing. I told him it would receive either a first reading or a first and second and after that he should expect more criticism, which happened. I assumed that more discussion would be needed.
I know Mr. Bulleit said one reason to support the residential parking permits would make a house more valuable but I disagree and only think it could help with marketing a house.

Mark, we can agree that we would like to see more transparency with appointments and all matters in general.

I think that we could agree on more than just that. I agree that looking at both(all)sides of issue is a very good thing. Some of my friends call me "on the other hand".

You guys are thinking small on Coyle. City buys, helps with cleanup, sells it at low cost or at coast to a developer with an approved plan that will improve the neighborhood, money back into TIFF. Win win win.

Or - City/county improves the property with a government complex, retains the historic building, etc., which improves the neighborhood and spurs more improvements around the area. Win Win win and tax base still increases.

Right now I think the city needs more supportive bodies to help the process. I'm not pissed at anyone most people here care about their city you can't get upset at that. Some of us just go about it differently.

What cracks me up, people here think they can read a few pages and understand TIF's or Sewer issues.

Us "little people" seem to be the only ones who are looking at the big picture here.

Why should the council and mayor or redevelopment care?

Answer: It's not their money and it doesn't affect them, accept what's in it for them.

I bet if the truth be known, they couldn't answer the hard questions.

Tax abatements and TIF's are killing our city.

Would someone explain to me why the county has only given 1 tax abatement and the city gave 32 million worth last year, but the county has money and the city does not.

Why city buy and fix? Because the city can put conditions on the sale and approve the project to make sure it benefits the city. Happens all of the time. Cities buy a building, put just enough work to make it marketable, sell it for dirt cheap to entice someone with a good plan.

Coyle has never been on the open market, so nothing stopping private development if it goes on it. Just hate to see building dozed and some sh*t go up.

Can someone tell me how a commity in New Albany can spend $45,000 on a prospective purchase of a building for the city, and then come before the council to ask if they can further investigate purchasing the building?

Shouldn't asking the council to possibly buy a building be prior to spending $45,000 on a building that the city might buy.

Would you say most of Europe is bike friendly?

I heard and read were two Parisian Mayors changed two-way streets in their district to one-way but on the same street and in opposite directions. I guess the French don't oppose some one-way traffic.

Harrison County got the riverboat and we got what all the anti-boat people said we would get if we had the boat. Porn Store, Strip Club, Asian Spa (or whore house), thriving pawn shops, and liquor stores. Oh yes, we got the Y but Jeff has one and they were not bought off.

Now Kentucky assemblymen are forcing slots through its assembly because of Indiana. Indiana gets riverboats and Kentucky possibly loses Horse Racing.

Love historic buildings? The London historic preservation guidelines are FAR, FAR, FAR more restrictive than here in New Albany. That city doesn't look great by chance. It takes GOVERNMENT SUPPORT of preservation to maintain a beautiful city.

I would say Europe is more bike friendly when you compare it to North America, but each individual city in western Europe has diffirent degrees of friendliness toward bicycles.

As far as the 70% of sells the Belgiums have. I personally prefer Miller to Bud, pilsner to lager, but I drink craft beers too. Everytime I set down to drink a beer it doesn't always have to be craft. Absolutes are dangerous.

Local churches that members of which spearheaded the campaign against the ordinance that would have allowed the boat locate here.

(no I am not saying all churches, or all church members did this, but there were high profile local churches that did this, and I (the clinic in floyd and harrison)have to compete with them for the grants.

I know the Providence Center on Charlestown Rd received a grant but they are not a chruch and were not around when the ballot was being voted on.

If I recall correctly the second initiative almost passed, maybe the people applying for the grants are the ones who voted for it.

Like you I sometimes feel that people who voted against the boat do apply for grants but I can't say that with any proof.
