SHORT BUT NOT SO SWEET

There were only two items on the agenda tonight, so our city council meeting only lasted about 40 minutes.

The items in question were:
G-10-02 Ordinance Establishing a Full-Time Common Council Attorney. There was quite a bit of discussion both pro and con. Mr. Coffey and Mr. Price both stated that they had nothing against the candidate but with the city budget in the condition it is they did not see a need for a full time attorney at this time.

Mr. Gonder did not believe that the city was served by a part time attorney. He mentioned all of the questions about the sewers, cleaning up the ordinance book, and people questioning our local government's integrity. He added that there is a need to search out ways to utilize the attorney.

The ordinance was voted down 5-4 with Mr. Coffey, Mr. Price, Mr. McLaughlin, Mr. Gahan, and Mr. Zurschmeide voting against.

The second agenda item was
R-10-06 Resolution To Purchase Garbage Lids, and Lid Replacements along with Installation of New Lids From The Riverboat Fund. Mr. Malysz said the Mayor had requested this item be added to the agenda. There was discussion on this issue also but after establishing that the city owns these cans and is obligated to maintain them the resolution passed with a show of hands.

During the comments from the city officials, Mr. Malysz mentioned that the Mayor is interested in re-establishing a Human Rights Commission since there have been a few issues in the past couple of years that would warrant such. Sounds like an interesting idea to me.

Benedetti trial changed to May 10. Coffey opening a new blog. This should be real interesting. He has a good letter in today's Tribune but...the need to audit the Sewer books. I'm in support of Citizens being at the table with other council members. The Police need to go to a two tierd system and rein all this mismanagement of England's spending. While were at it we need to add a special New Albant beer tax.

If I deleted every comment from one person bashing another there would be very few comments remaining.

As I said earlier, as long as a person refrains from four letter words most comments will not be deleted.

There have been comments made about people's families and others which were very rude and in the worst taste. These were also deleted.

We are all adults, we should act as such. And personally I don't believe Mr. Baylor's feelings are hurt by the "beer belly" and "Commie" remarks. He probably gets a laugh, so you are defeating your purpose anyway.

And AGAIN as far as the "fence sitting", I do express my opinion in the comments section of this blog. I don't believe I should be editorializing while posting the details of a council meeting. That should be done in a factual manner in my opinion.

Under todays Cheers and Jeers the Editor states, we can not use EDIT for sewers.

Question: If we can make sewer bond payments with Edit, the Editor needs to do his homework. And the report used was given to Coffey from me and it was done by Horthwath.

Per our legals department, I was told they have received that financial report but they were not told of any deadline as to when it had to run by. It's scheduled to run this Friday, March 5. I don't know if there was some confusion or lack of communication there, just saw your comments and made a quick call.

I believe they've done some emergency work there of late, but Linden Meadows was managed by New Albany Community Housing, commonly referred to as CHDO. In today's story there's some info on what New Directions does. They run Repair Affair each year, did St. Edward Court and do emergency services for the city based on a contract.

STATE Law dictates the filing and printing of the year end financials. Feb. 28 is do or die date. As readers do not know when the Tribune received same, we would not know either what kind of snafu occurred.

Shirley, now they are giving YOU false information out of the Controller's office? Everytime in this town just when you think you know who your friends are you will find they are not so friendly when it comes to releasing correct information.

County higher uppers have had to step in now to force Auditor's office to release information to Taxpayers regarding City. It is getting bad. And, it is a shame. I did have more respect for some but losing faith rapidly. Election time is around the corner and I'm surprised County Auditor would even hesitate to do the job required. Shame when you have to have Department of Local Government and Finance on a cell phone so they can order the information turned over. Downright shame.

I was surprised at the outcome on the vote for the attorney.

I think that the overall cost and savings of having the full time attorney would have saved tax payers in the long run.

I read that the cost of the part-time attorney last year was around 21000 and that they had a budget of 26000 or something like that. But if they only budgeted for 26 they would consciously kept in mind to ration the amount of legal service. They may not be receiving the amount of legal information they need. Some of the same individuals that want more information, to make better decisions on votes, voted no. I asked one member why he voted the way he did and his concerns where that the 2010 budget worried him. Maybe after they figure the budget out the attorney issue can be brought back up.
And I know that I’m not accurate on my figures just ball parking
For the 14000 more they would have had unlimited accesses to legal advice.

There are more advantages other than this.

The Tribune has no obligation to print that or any letter. "Fredom of speech" as in the US constitution has to do with governments inability to regulate the press.

P.S. EDIT should be used for Capital Improvement Projects that are still needed for the sewers. I believe the sewer board is negotiating about $7 million more work with EPA.

Someone should add up the amount of sewer bond money paid, (principal & interest), insurance, legal fees, administrative fees, EDIT, TIF, etc. Then figure out how much per capita the sewer customers have paid from February 1990 to February 2009.

I believe TIF was used for sewers out Purdue's way. At this point, EPA may continue to say NO to any new development needed to tap onto sewers anyway, so any new jobs that require sewer use will have to go elsewhere (Clark Co?).

I'll try to offer a response to this. The crux to me is that the assessment in anonymous's comment excerpted above isn't true.

NABC investment monies have come from Main Source Bank, the US Small Business Administration, the owners and other private sources. We took advantage of the Horseshoe Foundation revolving loan program as administered by One Southern Indiana. We lease from Steve Resch. All of this is public knowledge.

As with the Bookseller preceding, I must act: What is it that we've taken or asked for from the city?

All I can think of is the sidewalk, which has been the subject of many assumptions, and even though I've set it straight before, I'm happy to do it again.

It was our intent all along to use a section of the attached parking lot for a patio. This we did, entirely funded by ourselves and the building owner.

We also had a plan to convert the streetside space into open air dining. This required negotiating with the city. If the city agreed to repair and extend the sidewalk, we'd spend the rest to make it look good.

The Board of Public Works approved sidewalk reconstruction, not just for BSB, but for businesses on both sides of us. We and the building owner paid for all the rest. I'm told that the bid came in well below what had been expected.

Divide the sidewalk expenditure three ways, between us, Ricke Associates and Fox Law, and it comes to somewhere around $2,500 for our share.

The sidewalk dated from the mid-1950's. Had the Rainbow Thrift Store, Fox Law and Ricke asked for a new sidewalk eight or ten years ago, I suspect they'd have gotten it.

I understand there's room for honest disagreement, but as far as I can see, the above figure for sidewalk repair and extension is the total to date that we've asked for and received from the city.

Can the writer tell me what monies we're asking for from CMs Coffey and Price?

Even though you two are a couple of transplants, stop asking for tax money and public assistance and start contributing.

BTW, in case anyone is wondering, as of August 3, I'll have completed 50 years living in Floyd County, of which the past 17 have been in New Albany itself. How this makes me a transplant is unclear.

Matt Denison told me himself that the Brewhouse did not get permission from the Board of Works before you done the patio, go look at the Board of works minutes folks and see that Baylor went before the Board of Works "after" and again I repeat "after" the patio was poured. Why because they got so many complaints. Where are citizens suppose to walk on Bank Street? I guess it's suppose to be ok we have to walk in the street to give you a patio. BTW scan your cancelled check on here and prove you paid your third. Do you really think us little people buy your BS? It is not up to us to prove anything, read the minutes. it's now up to you. Like we always said, if you have nothing to hide scan that bill from the concrete company with a date and a cancelled check. I understand from a family member of yours you won't be in business by the end of the year on bank street. Their words not mine. After England is gone from office so will those bike lanes be gone.

Matt's right, and you're absolutely right about the Board of Works timing. Try to understand that my company does not own the building, we lease it. After we met with the city to discuss the plan, I was left with the impression that the building owner would go to the Board of Works. This proved not to be the case.

As soon as I was made aware of the necessity of appearing to be the front man and explain, that's what I did. It was a mistake, but an honest one. Little I say at this point will convince you personally, but there are others who might be willing.

And: I didn't ever say that we paid for a third of the sidewalk. I said that we paid for eveything else, via our landlord's construction company. Rather, I said that the city paid entirely for the sidewalk, and that if you divided it among the three frontages, it would work out to a third for each.

You might ask Ricke, Fox, Mike Wickliffe, Mike Smith and others how their portion of the sidewalks worked out. I can't speak for them.

The sidewalk was reconstructed to provide egress for pedestrians as well as space for tables. That was the plan and the purpose.

I'll tell you about my profit and loss statements if you share your income tax return with me. Most people reading know that startups are tough in the best of circumstances. We work as hard as we can, just like anyone else.

What does this have to do with your point?

And: What do bike lanes have to do with it?

After reading todays Tribune, I sure hope TheNewAlbanian is never planning on running for public office. He doesn't get it either. Without sewers being fixed (infrastructure) there is NO development. Whar is EDIT? you got it, it is used for infrastucture and what is infrastructure? Sewers.

I have two serious questions.

Steve Price often says that we shouldn't put all the eggs in one basket.

Given this, should we put all the EDIT monies in one sewer system?

If I'm reading Dan Coffey's blog correctly, he's now saying that spending EDIT and TIF can reduce the rate of a fee increase.

He does not seem to be disputing the increase itself, merely looking for ways to reduce it.

Am I reading it right?

What a sweet deal for the owner of your building who got the contract. Boy does that smell. Like Henderson always said, if it's not in the minutes it never happen. An honest mistake, come on Roger, what was the Board of Works going to do, use a jackhammer and break up the concrete? This ia another example of what is wrong with New Albany. Most business would be fined and had hell to pay,splashed all over the front page. Agian folks, this is another example of knocking on the Mayor's door and getting something from Doug. Does free beer justify a mistake? No wonder England stays drunk at Studio's.

It's simple. I thought the building owner would do it, and he thought I'd do it. That's the sum total of the conspiracy. Any of you reading who's ever made a mistake in your life can relate to it. Those that haven't, cannot. It isn't nuclear physics.

And: Knowing that everyone's loading for bear to pop me as soon as I screw up, there's not much reason to screw up intentionally, is there? It'll happen eventually because I'm human.

I've always been told taht there is money allocated for repairing sidewalks. Like anyone might, we asked for it, and threw in money of our own to improve the building and streetscape. That's straight up, even if I can't change your feelings about it.

I feel good about it, because that section of the street looks far better than before, it's producing wealth, not draining it, and the cost to the city has been a pittance.

Ann the snitch & Nip #$%&! of Main Street said: Moving 5th graders to middle schools is a bad, bad idea. This coming from some one who home schooled her kid. Then enrolled her in St. Mary's. (boy you sure must sell a lot of seeds.)

Save Silver Street said: blah, blah, and blah. Hey sweet cheecks you all blew it last year when you supported the teachers.

They are just like the Police, and Fire they priced themselves right out of a school. You can give all the interviews, you can point your finger at the school board, Clere, Daniel's but the truth be known for three years the teachers union didn't want to give up nothing. They bitched about to many students, wanted raises and to keep their great insurance at a ($250 deductable.)They got their raises, kept their insurance but cost others their job. Add on all the TIF'S New Albany has and that also played into it. It's a waste of time it is going to happen, they are also redistricting and will be shifting students to other schools.

Do your homrwork lady and find out how much TIF's cost Silver Street and the other three schools.

They have the votes already so knock yourself out bit*ching, and while you're at it have Baylor jerk the Farmers Market signs and your Save Silver Street School signs down from where they are NOT suppose to be or we will. If it's good for some, then everyone should be able to put up a protest sign.

As they say it's the economy stupid and the mismanagement in New Albany.

Being away from the computer for a few days, I find how this thread has turned regarding the school systems announcement interesting at best.

Glancing through, I did notice that the anonymous horde was able to turn this against certain people in the community. (Such as Ann, which those comments were completely uncalled for)

There is a simple cause for all of this. Remember that little issue a couple of years back when a group formed to protest property taxes and demanded reform? They claimed they could not afford their to keep their houses unless the system was reformed. That they were speaking for the citizens and those with out the means to speak out? (little old lady syndrome again). I remember that, and I remember that is when I first got on the anonymous hordes radar screen and was listed for all out attacks. (one of the reasons I was put on that radar screen back then was because I said in a couple of years, if that passed, we would pay for by way of our childrens education.)

Well, here we are. 4 schools to be shut down, arts and music programs on the chopping block, local jobs on the line, etc. I tune in here after a few days gone, and par for the course the conversation is used a whipping post to attack certain people in the community because they dared to voice their opinion.

I have not read all the posts yet, but surprisingly I dont think anyone has asked how much the fancy LED sign outside the of the administration offices cost to install recently, how much does it cost to operate.

Why hasnt the idea been brought up to sell the multi-million dollar properities on grantline that house the administration offices, and move those into one of the school building that are slated to be closed.

Oh well, such is life here in good old NA, groups form and scream to get what they want, despite the writing all over the wall that it will come back to bite us all in the ass, the career politician fold to them, despite the warnings of what will happen. And when it all comes down, everyone acts so shocked, and hurries to make jabs at people like Ann (why is there such hatred for anyone who runs a successful local business around here anyway?)

Now fire up those keyboards and start attacking, at least that is one thing we can count on as being consistant in this town.

If you make so much money you can afford a sewer raye increase and all that you have posted: pay my property taxes and sewer bill. If not mine, maybe the little old lady down your street.

I am hoosier, I suggest you go to the auditor's office and ask Thersea Blaiss to give you that info. It's alot, but complicated to explain.

Also I suggest you contact Larry M. on the county council and he will explain how tax abatements have helped destroy the City of New Albany.

And why the county only has given one (1) Tax abatement.

Trust me, you will be impressed with what many do know and why we have the problems we have.

I for one do not want to see any schools closed. On the other hand I have to applaud the school system for actually making cost cutting measures and still being able to retain all full time teachers.

Could our local government learn from our school system and see that cutting cost can and does save tremendous amount of money and that the quality of services can still be maintained without always resorting to raising fees?

You know that will NEVER happen, because there is a level of accountability for ones statements at NAC.

As far as this blog, it has hit a record low level now.

Because a person is successful, and has made some exceptional choices for the education of their child, they are subject to such rantings, and if a person should try to defend them, the person defending the other is at fault, not those who made the statements.

This place ahs become an embarasment to the entire city, and clearly outlines the symptoms of the illnesses that have brought our city down.

Chris what is your take on the school actually working within the budget and making cuts to stay within the budget? You always appear to support increased fees (i.e. sewer) but not placing any emphasis on government to reduce costs. Your solution is to typically support increase fees and then counsel your clients on how they can reduce cost. Government is generally in the best position to reduce expenses rather than individuals and particularly more so than your clients. Why so little support for accountability in spending and the importance in implementing cost cutting measures in government?

Fair question and will do my best to fairly answer. (but first, I do not support increased fees for sewage, I simply accept the inevitable)

Of course the schools have to work with in the budget, that is a given. (even though that budgetary shortfall is a result of the property tax reform debacle).

Do I think they are making the best decisions, no I personally do not. Why would you close an excellent school, and leave a failing school 2 miles away open?

I question the decision to send 5th graders to "middle school", when my daughter was at hazelwood several years back it was very crowded all ready, and I assume Scribner is the same.

And I DEFINATELY do not support cutting any arts and or music programs out for any students at any grades, of course we can afford a $14 million dollar weight training room for high school athletics, but we can not provide an arts or music class?

To attempt to address you belief that I support increased fees in government, and my solution is counseling clients on how to make savings in their budget to offset those fees, simply put, I do not support new fees or taxes, I do not want them, nor can I afford them. However, there are certain situations where we, as citizens of a city, have no other alternative to but to pay higher fees to maintain a certain expected level of civil services.

And I do expect accountability from my elected officials, after all they work for US, not because of us. But do I extend that level of accountability to constantly rehash mistakes make 10, 15, 20, 25 years ago, no I do not. We can not change what has happened in the past, we can learn from it, but it does no good to fight about it, as is what always happens in this city, We waste so much time, money and energy fighting about what should have been, that we always screw up our future of what could be.

I'm not rehashing so called mistakes from 10, 20, 50, years ago. I am talking about now. The city including the sewers has spent over budget for at least the past couple of years now.

The school has taken the approach that revenues are and will be decreasing so they are making some hard and unpopular decisions in order to stay within budget. They have taken the approach that they have to address this now and cut their spending so that they don’t find themselves in the situation where they have no money to operate and are in default of their debt. When have you heard of this being done for the city or for our sewers?

The great SM Coffey, in his town hall offered no real solutions to this problem, he just cited history going back decades of why the citizenry should fight this and refuse to pay it. (In essence telling his constituency to risk there homes and the equity they have in the home should they have to sell, and to be fiscally irresponsible to protest fiscal irresponsibility!)

I do beleive that state law requires them to stay within budget.

Also, I do not believe state laws prohibits a utility to cut expenses in order for it's revenues to cover operational expenses.

I agree with the person who commented @ 12:09. There is no point in rehashing the past. We need to concentrate on the present and future.

All of this back and forth attacking is getting us nowhere.

Someone mentioned that the Children's Academy could be used as a youth shelter. They may have been joking but if we lose a school that may be a good use for the building. Same goes for reusing Silver St. for city and county offices.

We are in a terrible situation. The sewers are old and our budget is shot, our children will be bussed to other schools, our most vunerable children are forced to live in an old and unsafe building. CAN WE PLEASE WORK TOGETHER FOR ONCE????

Arts and music are just as important for the development of well rounded, educated youth as sports if not more so.

Also, in so far as music, the younger a child starts, the more likely they are to excel at the pursuit. (call me a know it all if you will on this topic, but I have been a musician since 4th grade, my was, and my daughter is, as well as my brothers, and most of my friends)

In so far as music and arts being privatized outside of school, they are, lessons of all sorts can be had at several businesses. but the last I checked, other than Jimmy music school of rock, there was no orchestra, concert band, jazz band, choir, bell canto, etc.

And most families, especially the endeared little people, can hardly afford private lessons.

We pay upwards of $80 for two hours of oice lessons for our daughter, who has excelled as a first soprano, has won gold at state level inter scholastic competitions, and is being aggressively pursued by nationally renouned colleges (Berkley school of music, St. Mary of the woods, etc) and has been offered amazing scholarships, all because of public schools arts and music programs.
